Misleading Information

On May 10 I was looking at a Rolex watch at Benchmark Jewelry at Valley View Mall at Preston Road Dallas, Texas, when I was approached by the salesman name AJ. He said these watches are beautiful.

He said I could give it to you with special promotion. I told him I don't have money this time perhaps on coming August 'cause I got many obligations right now. He said no problem, come with me I am going to explain it to you.

For six months all you need to pay is a minimum amount with no interest. I asked him, and after the six months what will happen? Someone will finance you with very little interest of $1.99 until the balance is paid.

I told him I need to talk with my wife first, he said okay I will call her, he asked for our Phone number and talked with my wife, (I knew that my wife is furious knowing I am buying a costly watch) so he gave his cellphone to me.

I told my wife to just listen to him, 'cause I am not buying it anyway. Then AJ told me that my wife approved it, and that she also wants another watch for her. I told him I need to talk to my wife first. But my wife didn't answer the phone anymore.

So I went home with the watch. When I got home my wife is so mad at me, shouting and not letting me to explain. She said she doesn't want to get involve in any of my transaction regarding that watch. I took my wife with me to Benchmark to tell the guy that he is lying. She is so mad telling the AJ that he is a liar, that she didn't told him that she did approved it.

I tried to return the watch but AJ told me there is no way I could return the watch 'cause their main office is close, but I could return on Monday and talk to his manager.

AJ calm down my wife and explain that your husband likes the watch, look at his face, wouldn't you want him to receive a gift from you on father's day, besides look he said, I am going to call my manager (on his Cellphone) and ask for a year of payment without interest. My wife looked the watch and said okay I will give it to him as a gift.

He then took a document for my wife to sign, explaining to her that this is an assurance that in case something happen to your husband you could claim the watch. And then he made a call to somebody and asked my wife to talk with the guy, explaining that it is just a verification.

On Monday, I called AJ explaining that the watch is refurbished and used as explained in the document. When I went to the store with a policeman, he explained that the statement does not apply to my watch, although it is clearly stated " Item sold above is refurbished and preowned"

On May 20th we received a billing statement with my wife's name in it, with a balance of $2,750 from Bechmark credit company. I thought my wife is going to collapse (She had a weak heart) I calmed her down telling her I Will verify this. She said I never applied for a credit, beside I don't have a job.

I also received a letter advising me that my credit application was denied. And another credit card from GE money lending company. Which I called immediately to cancel the transaction.

I called the numbers listed on the statement telling them that we never applied for a credit, especially my wife. I was advised to tell my wife to call them so they could send a dispute form. I was angry of what is happening.

On May 21st I received a call from AJ, asking me about my watch. I told him that he did a bad thing by applying us a credit without our knowledge. I went to the store and asked him if I could return the watch. He said the company has no return policy, he said it is written in document that I signed.

I told him it stated that "No refunds are given on layaways" The item I have is not on layaways because I had it already, besides refunds means reimbursement of money to customer when they returned the item. He said no, no Refund means no return of the Item. I told him your policy is wrong.

Check this out, when I asked him, "after I paid the whole amount of $2,750 at Benchmark, I will be offered of $1.99 interest until the balance is paid right? That $1.99 is APR right?" No, no he said again, that $1.99 is monthly. I told him if you are talking about interest, you are talking APR not monthly, that is what it is, I told him, but he insist that it is montly.

All I want is somebody to help me return this watch please. Punish this guy and the store for this kind of scheme, I knew that there are several people had already complained about this store especially that guy that work with this store.

Respectfully
