After exhausting all of our options and patience with Mojave Amplifiers and their owner, Victor Mason, I feel I have no other resolve than to post a Public Warning to all clients of Mojave Ampworks.

On or around June of We discussed and signed dealer agreements with Mojave Ampworks to bring in this line of amps. Since our store was geared towards the heavier line of amps, we had originally asked to get started with the Mojave Peacemakers. This request was denied and we were forced to bring in the entire line of amps first, with the last amp, actually being a Peacemaker. I did decide this was the only route to get the Peacemaker, so I accepted, signed the dealer agreements and sent off Payment to Mojave Ampworks

The original opening order was as follows (since I was told by Victor Mason, that the Peacemaker had to be the last ordered):

Coyote 1x12 Combo Ceramic
Sidewinder 2x12 Combo Ceramic
Plexi 45 2x12 Combo Ceramic/alnico
Scorpion Head
2x12 Ceramic/Alnico
Peacemaker Head
4x12 Ceramic

Sometime in August we did receive the Coyote and Sidewinder amps. During this time, into September, We did have (2) Hurricanes pass through and Mojave was placed On-Hold. Victor was kind enough to check in on us with the following e-mail exchange dated 9/29:

Thanks for checking in with me, it has been so hectic. We have not been wiped out, just massively detained. Start the facts out with the 1st Hurricane, Packed the entire store and made it through with roof and water damage. I also had and still have Pneumonia going in & out of Doctor's to try to kick it out. After we had a 20" section of the ceiling fall in and got that repaired and the water damage contained, by moving all equipment out of the store into a temp storage, we had to wait to get electric back for almost 2 weeks and phones. Finally were getting the store unpacked and almost back, then BAM Hurricane Jeane, we had to evacuate the store again, because the roof damage was fixed, but the inner roof was still open. Lost electric again and now are finally still unpacking the guitars. I lost some desks that were wood to the water, some accessories and a Hughes and Kettner Zentera amp, because we put a box of pedals on top of it and the box was full of water and we did not see that coming and of course we lost the pedals, as well.

Personally, we lost phones and electric a bit and our 20' wall of ficus trees fell down, but we were OK.in the middle, I did have to cancel that Taylor clinic, we were having. But I estimate we should be back to normal by the end of next week. The massive loss of revenue is hard to make up in both businesses, but I have been selling some prized guitars, lately to help make up for some loss.

In the meantime, These amps, you sent, I did not get the chance to play or hear, yet. But they were gorgeous and HEAVY as hell. Any casters for them? (Important Side Note for later-on) They are the heaviest combos in the store.

I believe that I still need to send you the original dealer agreement, which I would like you to email me again. Then Next, is I need to send off a check for the Peacemaker Head and 4x12. Is that done with the mods and ready? I am sure you are much more ready than I am down here, but our files are still packed.

On 10-1, we received the following e-mail from Mojave, which was subsequently sent to all dealers at that time: (Important side note for later-on)

Hello Mark & Fred, Bo, Robert, Junior, Gene, Curt and H.L.

Thankfully were small enough of a network that I can speak to all of you guys and do it on a first name basis. First I want to say thanks for being my dealers. You guys are all hand picked for the most part for a variety of reasons. I don't add dealers like most other manufactures. There are plenty of us to do the job and to keep this product profitable for you and us. Mojave's buy-in is a tall order compared to most small companies, 5 amps and 2 cabs. I've kept it like that through thick and thin. Most importantly I have maintained a great deal of integrity with the product and the customers.

Anyways, after some rebuilding and organization of the store, we did get to try out these Mojave Amps, finally. The Sidewinder was a decent amp, as was the Coyote, unfortunately, the Coyote came with defective power tubes. Browned and and shut down, we asked Mojave via telephone about this problem and the volume of these amps. We were told that new power tubes would be sent and that they just released a power attenuator mod. If we want we can ship these back for the mods or the clients can ship them to Mojave to get them installed at no charge.

Fine, we would await the power tubes. (Keep in Mind, Synergy Guitars, does not do repairs or lessons) so unless we get the tubes from the Manufacturer, I would have to go down to my local Guitar Center to get them.)

I was a little disappointed in the performance and as stated previously, the lack of casters for these "Heavy Amps" As with all stores and other lines, this was not an urgent matter, as we had just recuperated from the Hurricanes and we were in the plan of moving the store, shortly.

This fell by the wayside until March when I received the following email from Victor at Mojave:

Hey Robert,

I sent tubes but I'll send 2 more out today. (Note, as of January we never received Tubes from Mojave Amps) No listing on Mojave site until the order process is complete. (This alone, disheartened my feelings for this amp line) You had basically purchased 2 amps from us. Far from the 7 we agreed on.in light of all that has happened to you, I fell compelled to stick with you. I just need the word and we will finish what we started and complete our agreement.

Mojave is jamming along. Were growing well. I have no ambitions of adding new dealers. You were the last I had worked with. I'm doing more then I can keep up with the demand at present. We developed a circuit called Power Dampening that allows the user control the power level the amps works at. Not an attenuator or varaic or anything else like that. It makes the amps works at low volume with the same tone. That has made the amps sell like fire since the tone is unmatched.

Call me at your lesure. I'm sure when you get settled you will be in good shape to grow your business and be a strong Mojave Dealer.

That about sums it up. I am in the midst of moving a little west closer to the Interstate. Right now, I am closer to the beach with barely any room for clinics. So, out west, I can have clinics and local battle of the Bands.

I am in the process also of revamping the site and launching an e-commerce site for the lines which I do not carry middle or lower in the store. I did not receive the replacement tubes from you, They are (2) Ruby EL84CZ. (Imagine that in 5 months, we did not get these tubes)

Since, these problems have come up on my end, I cannot figure out if there has been an interest in Mojave or whether it still remains to be seen, once I go up as a dealer on your main page? Last time we spoke, I was waiting on bringing in the Peacemaker stack, next. I just have not had a whole lot of interest and I think it is because I was not listed. I do not know that there would not have been orders, if I was listed all this time, so it is hard to judge. (Important point: In 7 months, even though the previous e-mails were to Mojave Dealers and all our paperwork was signed, we were NEVER listed as a dealer on Mojave's site, which impeded any and almost all interest in these amps, in my opinion)

Irregardless of the problems, I truly believe in where I want the store to go and some stumbling along the way does not deter me.

On 7/15, we still have not received those power tubes for the defective amp, still were not listed as a "Dealer" and I sent the following e-mail off to Victor at Mojave; We did move the store to our New location and we got settled in, just fine.

I am settled in the New location and would like to actually complete this
order with you. I would like to get the Peacemaker half stack in first and
then the rest of the order as we agreed upon.

I still have not received the replacement tubes for the 212 Sidewinder.
Please use my UPS account 9xxxxx to send them as to assure they actually get
here, or include them with the Peacemaker shipment.

As you said in your prior email "I'm sure when you get settled you will be
in good shape to grow your business and be a strong Mojave dealer." That
vote of confidence was much appreciated.

It was this e-mail which marked our downhill relation with Mojave Ampworks and eventual theft of $3,790.00.

In reply to this e-mail, Victor called me up and we discussed the line, the missing power tubes, the non support from his website, not showing us as a dealer. This of course led to the fact that, without telling us or even a call, Victor opened up Rock Solid Amplifiers as a Mojave Dealer, less than 20 miles away.

Nevertheless, guess what he just ordered? All Peacemakers! After all that we went through to try to get the Peacemaker and were put off to bring in the other amps, first. This idea just rubbed me the wrong way. This ensued to a back and forth conversation with Victor, about who's fault this was. Of course, it was my fault, I'll take 100% responsibility from here on out, I trusted Victor and Mojave and got the first screwing.

Here comes the 2nd...

At the end of the conversation, Victor came up with a great idea. Since we were done, why not send him back the amps for a full refund. He said he was backordered and could use the amps to get out to clients. This would help him and help us, since we had no interest in staying with the Mojave amp line.

I agreed (Bad Mistake)

I immediately had my assistant pack both of those amps and send them back via UPS fully insured.in the move we were missing a Mojave box, so we just used another amp box, instead. They arrived @ Mojave Ampworks on or around 8/22.

Here is the e-mail I got from Victor;

Robert,

Your two amps arrived to my shop this morning. Unfortunately the 2x12 combo (Sidewinder) was not packed in its original factory packaging but instead it was poorly packed into a make shift box with inadequate interior packaging resulting in damage to the cabinet. The amplifier had broken loose from the cabinet and will need repair.

The Coyote 1X12 was packed in it's original packaging but when unpacked I found it had a smashed right rear corner, a dent on the right rear center area, a tear on the back panel center board, a dent in the bottom portion of the cabinet. (Imagine this? Even in original packing, it had all that damage? This was the amp that, actually was defective and never got played or moved, because we never got those tubes, remember?)

I can't see how that occurred in shipping but in any event I will have to take both of these cabinets to the cabinet shop later today and see if they can repair the damage. If not or if it's more money to fix the damage it will mean replacement for one or both cabinets. Also there were no casters packed with the 2X12 cabinet. (I referred to this in the e-mail, above, whereas both of the amps did not come with casters) The power tubes are also missing from the Coyote amp. (Not the Missing tubes, again? After all that struggle to get the tubes that were never sent, I was blamed for them, here!)

They were absolutely perfect when I sent them and packed them. The Coyote had no power tubes because I was waiting on replacing them. Please send me pics of the damage. (To this day, I never got those pictures) There was not a single scratch, nor dent nor ding on either.

Ps. How did the boxes arrive, torn aport, gaping holes, etc?

As far as casters there were never any casters received with any mojave amp. We need to report this to UPS. With photos of sustained damage.

There, I covered the tube discrepancy (Lie), then I covered the caster discrepancy (Lie) and the most normal thing in the world, asked for simple proof. It was fully insured through UPS for damage, If it truly was busted u-p, let's file a claim. There are sometimes that UPS or Fedex legitimately drops amps from 3 feet high, I've seen it. Perhaps, they weren't LIES.

Wouldn't you ask for some proof?

Victor of Mojave Amps responds:

On the 2X12 it's not shipping damage, it's damage from poor packaging. The boxes were not torn open. Your not going to get a claim man, the packing for the 2X12 was non original and weak. The Coyote packing was good, damage might have occurred form the shipment but it's hard to say. I will have to carefully examine the box. Even so they won't care if the box was banged; they only care if the box is torn. (Here, he is implying that UPS will not honor a claim, so don't even bother. Why, because it was lies, obviously) Sure I'll take pictures. As for packing I have the packing materials here. If you really want to pursue a claim I'll cooperate. It makes no sense to me since I can plainly see there wasn't any way for the poor 2x12 packaging to have prevented the chassis from breaking free from the cabinet. If it had been packed in the packing materials we had designed it certainly would not have been damaged. As for the 1X12 some of the damage is scuffing from handling, not shipping. I'm certain of that. The only two areas that are remotely possible of having been damaged by shipping are the large dent on the top back right corner and the indent on the back of the cabinet. I'll shoot pictures and email them to you on your request. I'll try and do that today or this evening if time permits. (Still up to Today, I have never seen these pictures)

Victor, then also followed up with this e-mail, a few hours later;

I've got my hands full right this minute. I was planning to take the cabs to the cabinet company and ask for a repair from which I will have some kind of figure. It's not that much I'm sure because I can simply replace the cabinets for under $200 each. If you want to settle this now I will ask enough to cover repairs, $200 for the both of them. That's splitting the difference in the event I have to replace them both. I'll still get you some pictures Robert and save the packing until you decide what you want to do.

After all this, What would be the best course of action? My parents always taught me to "Cut your losses" so, I promptly agreed to giving him the credit, even though, I knew he was lying. But, I still want the pictures, right?

Here is his response the very next day, 8-23;

I went to take photos and the battery was dead on the Camera. Its in the charger right now and should be ready in an hour. I've also taken a close look at the two amps. Of the two you do have a claim with the Coyote. It was mashed by either excessive weight or a poor handling job. There is clear evidence that the Coyote or 1X12 was damaged from the shipment. (UPS did break it, then) Again I'm talking about $100-200 worth of repair or replacement cost here. Do you want to call UPS for a claim? If so you need to do it now.

Victor, if it is $100-$200, it is not really worth the time to file a claim. Please deduct this from the check due. Sorry for any inconvenience that UPS has caused.

This is where things go wrong, again; Our exchange, a few hours later... I suggested, that after (6) weeks, perhaps, he should cover the repairs on his end, I knew he was lying, anyway and we never did see those pictures, look how Vile and Nasty he gets.

I do not believe there was any damage, as you never furnished me with proof, via photos. I agreed to this to expedite payment. I will be patient and wait for the check. I do not appreciate your comment about drug use, as I have never used drugs in my entire life. Do you tell everyone that they are "High on Crack"? I happen to know quite a few musicians that do not use drugs, not everyone is a drug user and it is a very disrespectful comment.

The fact that no one was interested in your amps at my store, could have something to do with that attitude problem, if you treat all your clients, as such. Lines come and go, but you only get to burn your bridges, once in this industry.

Curious as to why such a hateful response?

Even if I did nothing with you or your company, does not mean that I did not Pre-Pay the amps. I did, you had SOLD them to my store. If I never became a dealer, it was not a big deal on your end, you lost nothing. Either way, You sold (2) amps. Did you lose any money advertising on my behalf, as a dealer? No. You offered the refund and stated that you could use them, as you were behind on the production.

I should have offloaded them on EBAY. It was better for me, that way. It was better for you to have them back at the time, I did not ask you, you offered. That's the difference.

I wish you the best on your endeavors in the future.

Don't push me. First Your 6 weeks of waiting for payment is nothing compared to the nearly 2 years you did nothing with the amps from the date I sold them to you. (To reiterate, we had no dealer support, a defective amp and (2) brutal hurricanes) The fact I'm buying them back after that long should be considered a gift. (Now, it's a gift? If you remember, it was his idea, due to helping him out of his backorder) If you think your doing me a favor sending two amps back to me that arrived damaged your high on crack! (Still never got those Damage Pictures, ever! Now, I have to take abuse and be accused of being high on Crack, which is something in my 37 years, I have had the pleasure of never actually seeing or knowing someone, HIGH on Crack) I build these new and didn't need old ones to buy back. (He did need them, at that time of being heavily backordered) The timing on this deal was weak for us and apparently you. I'm not eating the damages I already PAID for. You want them back? You will eat both the shipping to us and back to you as well as what I had just paid to repair and recover the damaged cabinets. I couldn't even try to sell them until I got that sorted out. (Hmmmm... Take them back?)

Now I don't want to hear about how bad you need your money, that's not my problem. (Nor, was it my problem of hearing how bad he was behind) If you want the payment form us then please be patient as you will be paid. (5th Promise of Payment)

On 11/1, I inquired again about the refund. Down, here in South Florida, we just passed through the biggest hurricane we have had, and it was BRUTAL. Here is my e-mail to Victor at Mojave about the refund;

I would like to ask you for the refund check to be sent, we were hit very hard. My family has no electric, no telephone and moderate damage and we have been running a generator for the past week with an eta of electric in mid november. The store has suffered roof damage and overall 40% damage to equipment.

I can use the money, now. Hopefully, you can get it out to me. It is now (12) weeks from the date I sent the amps back.

- 200 in repairs because of damage that was sustained in shipping.

Total: $3021.50 total refund in 2005.
(After all this reading, did any readers, hear about a restock fee? I certainly never did! What a THIEF!!!) Just making this up, as he goes along, huh?)

This has not been paid to Synergy Guitars yet but it was supposed to be refunded in 2005

Thank you for the update. I hope things are going well. I do know we agreed to the repair cost, but we never spoke about the 15% restocking and I sincerely would not have sent the amps had I known there was a 15% restocking fee.

After this wait for 6 months, I will feel lucky to actually be reimbursed, so I will not hinder this, but we never spoke about it nor was it implied.

After that e-mail, I did not get a response from Victor until 5/4, almost 9 months later. During this time, I emailed him with the emails below;

I think that is overkill on trying to get our refund. Unless I receive this check by April 28th, you leave me no choice except to start legal and public actions against Mojave. This is not a threat, but again, you have left me no recourse and have stolen this money from my corporation. You have brought it this far. I am sure you have much more to lose, than I do in a public war against Mojave amps and your underhanded tactics and theft. (I warned him of this Public War, now it is Public)

From here, I did not receive anything and I decided to call Victor Mason via phone and try to get this straightened out. On April 25th of after all this time and all these promises, to say I was not in the best of moods for this call. Even though I was right and he was a sneaky liar for almost a year, does not mean you win. It came to a point, where I told him, he robbed me and he told me he did not like my attitude. I also told him about never getting the pictures and the sneaky 15% restock fee. I even told him that after (11) months, he could have sent me $1-300.00 per month in small payments until it was done, anything, but he sent NOTHING. Imagine what his answer was to this all?

This is when Victor Mason of Mojave Ampworks actually told me "At this point, I want to THANK YOU for the FREE AMPS!) Then he hung up!

Imagine an Amp Manufacturer, robbing a Dealer for a year, promising to pay them and then finally "Thanking them for the FREE AMPS, since they had no intention of ever paying for them. This is what happened on this day. Victor Mason beat me, there was nothing I could say to this. He robbed me and it was over. He won, I lost, I admit it! Is this the company you want to purchase an Amp from?

It was a shocker!!! What was even more of a shock, was he won! It was over, Evil beats Good, Bad wins over Innocent! The Fat Lady Sang! Oh well, I was robbed by the best of them!

I then immediately sent a Better Business Bureau complaint of this whole story. You can see their file, here:

They of course, never responded to the BBB, either.

Can you possibly imagine that about (2) hours later, Victor actually called me back, I was shocked, what more could he say? This man beat me, he won, what else? Shocking enough, he had a change of heart and told me, he was mad and it was actually a great idea, I had about sending small payments out and this is what he was going to start doing, immediately. 10th and final promise of payment!!!

He asked me if this was OK and if it worked for me? What could I say? Of course.

Of course, I NEVER heard from Victor, again!!!

I would like to ask, one last time for the $3,583.00 Reimbursement. It has been close to a year and a half. Last time we talked, you had won and thanked me for the free amps. You then called back and said you thought it over and would send small payments until it is done. This has not happened. You refuse to return my earlier emails. How can we clear this up. I am also open to taking a Peacemaker half stack and the difference in cash.

I never got to see Victor at NAMM, unfortunately. I never did get the refund, I never did get small payments. I never did get those damage pics. Mojave has been dropped by a whole lot of good dealers, throughout the country, hopefully, I was the only one, that got robbed. Next time, you think about Mojave, buy something else, there are so many better amps out there. Don't get something from a company that can't even reimburse their dealers. I just don't trust them!

I waited since 8-22 to post this, it has been 1 Year and 5 Months waiting for reimbursement.

We are intellectual property counsel to Mojave AmpWorks LLC. As you may know, our client adopted and has used the trademarks MOJAVE, PLEXI 45, PEACEMAKER, COYOTE, SCORPION, and SIDEWINDER for more than 6 years, and has established substantial good will in these marks.

Not even to refer to Victor robbing my corporation of $3,790.00, but to sue me to have this story publicly posted for having the mark Mojave on our website, when we were an Authorized Dealer and allowed to use these marks. Now that I posted this theft, they want me to remove it or go to court.
