Ripoff, misleading, dishonest billing

In about 1997 I recieved the offer for the first bank of marin card. I DID note that when you activate the card you would recieve it with a charge on it.

When I recieved my cards I had, I think, less than $100.00 dollars of available credit, I don't remember exactly. I made ONE charge for $13.00. When I recieved my first bill I was a little short of funds so I put that bill on hold for a a little while.

Well unfortunatley I had forgotten about it until a rep called me one night. He told me that I was late with my payment and told me that if I made a convinient payment with him over the phone, because I was a new customer he would waive the 25.00 late fee. I gave him my bank info to make the payment.

What he did not inform me was that there was a 5.00 phone charge and when I got my second bill I noticed that not only was the the payment by phone charge on my bill, he had never even taken the 25.00 late fee off my bill and this caused me to go over my limit, now I had a second 25.00 charge for being over the limt. I called the company immediatly and asked to speak to a Supervisor. I told her my situation and she was absolutly unwilling to work with me and pretty much told me to deal with it. I slammed the phone down immediately cut up both my cards and wrote them a letter stating all that had happened and told them to cancel my card.

Now I'm sorry but when I hear the words Cancel, it means just that cancel the card and all I owe is what I was originally responsible for. It doesn't mean keep it open and continue adding late charges.

The next time I checked my credit report there they were saying I owed way more than I truley did. I contacted the credit reporting agencies and explained the problem to them. The next time I check my report I swear Marin was not there but the last report I just recieved there they are as a charge off/bad debit with a total of 400 and some dollars.

I did not have a problem with paying them the 13.00 I charged and the balance that came with the card when I recieved it, but I am in no way going to pay more money than I owe just because these people can't seem to run a business properly and give shoddy customer service.

Any ideas on how I can get them off my credit would be greatly appreciated.
