Unfair and unconcerned about the rights and families of noncustodial parents

I am the wife of a non-custodial father in the state of NJ. The Family courts in this state don't care about the rights of the fathers at all. When his daughter's mother left him, he was losing his business and his home. Not to mention he was a single father with custody of a 10 year-old son from a previous relationship. When he went to court for the childsupport order he had receipts and cancelled checks proving that he was taking care of his daughter. The judge didn't care and automatically placed the childsupport $10,000 in arrears based on the average salary in his field.

Shortly after the court appearance his ex moves to PA and does not notify him or the court. He called her several times during the course of a year begging to see his daughter and know where she was. Twards the end of that year is when I met my husband so I am a witness to several of these nightly phone calls. Knowing that he was nolonger at his previous address she filed for sole custody stating abandonment knowing that he would not recieve the papers to appear in court. When I saw how vindictive she was I told him not to tell her about us until after he goes back to court for visitation. He didn't listen...

Being that we resided in Hudson county and she filed in Somerset county Hudson county probation was in charge of inforcement and Somerset issued the orders and disbursed the payments to her. Very confusing to say the least. Over the past 5 years she has called Hudson County at least 10 times claiming none payment which resulted in us having to get a lawyer and go to court just to keep my husband from being arrested for non-payment when we were paying.By her doing this she has successfully managed to keep us from going to Somerset County to contest the amount of child support, fight for visitation, and alert the court of her residency in PA for 6 years now.

During the course of 5 years we have only seen Samantha 1 time when she was 2 years old. And that was because my husband met her and her family way out in PA at some punkin festival and she didn't know who I was at the time.

My husband has lost 2 jobs do to harassing phone calls and letters from Hudson Probation. Employers see probation office on a letter demanding child support be deducted because there employee is $10,000 dollars in arears and they assume the worst and fire you. Yes, these letters were sent to the job. Or you have to take-off from work yet again to go to court for non-payment accusations. Finally at our fifth visit to court our lawyer presented all of the other dates and that she was abusing the system. Especially since she never came to court herself.

Since the birth of our second child we have been having financial trouble. We do not qualify for any type of assistance due to my husbands gross income. We can't go to court to have the childsupport modified because we nolonger have the money for a lawyer, but she gets an automatic increase every 1 1/2 to 2 years.

My husband is now unemployed and there have been times when we have had to choose between paying childsupport or buying food for the house. While his ex lives quite comfortably in PA with her parents.

hen are non-custodial parents and there families going to get the rights we deserve? I believe if a woman cries wolf to the court system and they back her... They both should pay the price! Being that I have 3 small children I can not work fulltime. My husband only gets $560 / per week in unemployment and $199.00/ week is taken out for child support for a little girl that we don't even have the priviledge to know.

If the NJ family court would just be fair, custodial parents wouldn't be able to minipulate the system the way that they do.
