Sells defective homes and wont refund any money!

On July 3 we moved into the ARC Community, Meridian-Sooner. All ARC communities were running this, supposedly, one time only deal where you pay $999.00 down lease to purchase and the financing is done through ARC. It really was a great deal because this was a no interest loan and the home would have been paid for in six years.

We moved into a 2005 Oakcreek 16x80. Mind you, on Oakcreek's website, they claim to have the best warranty in the business. What a joke that is!

This home was setup on a small slope. The back of the house was only about one foot off the ground but the front was around six feet off the ground.

In October, our kitchen counter top started to bow up in one of the corners. This was reported to the manager, Sharon Ogren, immediately. Oakcreek sent out three different contractors to "look" into this. The first contractor re-leveled the home and looked at the color of the counter top for replacement. Then two more contractors came by to also look at the color. The last guy actually broke the counter top while pulling on it. This went on until MARCH when it was finally replaced. Five months to replace a counter top, quick aren't they?

Meanwhile, in November, our floors started to bow up along the support beams. Once again, this was reported to Sharon immediately. The guy that broke the counter top looked at it and said that the problem was, get this, they used too much glue on the seems when it was put together! The problem with the floors started out in the kitchen and then slowly moved through the entire house. It was as if the entire frame was bending.

Oakcreek sent out another contractor to look at the floors. He told me that the problem was that when the home was put together, whoever nailed the floors down missed the beams. I said, "Through the entire house?!" He had no comment.

In about April, where the floors were bowing up, they started to cave in! There was not a room in the house that this was not happening in. Sharon came by to look at it herself. She said that she would contact Oakcreek again. After weeks went by, and hearing nothing, we contacted Sharon. She said that she has left numerous messages but Oakcreek was not responding to her calls.

Around May, a large crack appeared above the front door making the door difficult to open or close. This home had vaulted ceilings and large cracks started to appear all along the peak. It was almost as if this house was pulling apart. This home had become uninhabitable. Oklahoma Landlord Tenant Act Section 118 A. 2. Says that a landlord must make all repairs and do whatever is necessary to put and keep the tenants dwelling unit and premises in a fit and habitable condition.

Sharon's only solution, since Oakcreek was not responding to her calls, was to move us. Since there were no homes available in Meridian-Sooner, we had to move to another community. Due to my husbands job, we had to remain in about the same area so, we chose Burntwood. Luckily they had one home available, and it was not an Oakcreek. However, this home is a yes used, Fleetwood.

When we went in to sign the papers for this home, we met with some guy from their main office here in Tulsa, who was very rude. He informed us that since the lease we had on the other house was, supposedly, a one time only deal, they couldn't carry that lease to this house. He said that we would have to rent this house for four years and then it could be financed. Since they would not return any of our money that we had put into that defective house, so we could find somewhere else to live, we signed that lease and moved in the end of June. They did give us that week for free since our payment was current on the old house and they did transfer our $100.00 deposit. Plus $235 was to be taken off our payment for July.

In July, due to some mix up on dates, we had to go sign another lease. ARC puts monthly statements on your door to let you know how much you owe for that month. Since we didn't get one for that month, we asked Sharon, who had been transferred to Burntwood, how much we owed for July. She said that she would have to get back to us. We heard nothing from her.

Around the end of July, Benton, one of the big bosses, from Tulsa was here for an inspection. He said that the second lease was wrong and that they had to transfer the $999.00 and just credit it to our account, which we were told that we would owe no payments until September. But, when we went to sign this new lease, we were informed that they couldn't just credit it to our account. That money had to be held in an escrow account for one year. Once again we inquired about how much we owed for July and was told they would have to get back with us.

Now mind you ARC has you sign two leases. One for the house and one for the lot. That doesn't seem legal to me. The same company owns both. That wouldn't be any different than say, you were leasing a house and the landlord had you sign one lease for the house and one for the land would it? Of course, I know why they do this. It is so they can get their outrageous late fees out of you ($35.00 for the house, $1.35 a day on the lot).

Also, that so called one time only deal, was run again this July. They had signs posted at both entrances advertising it!

Now August has rolled around. Once again we did not get a statement so once again we called to find out how much we owe. Once again we were told they would have to get back with us. Oh, they got back with us alright. With an intent to file for eviction, that stated we owed $1265.00 WTF!

We tried to make payment arraignments on this but were told that they can't work with us on this and that we had to have it in the office today by 1:00 pm or they were going to file for eviction! I'm sorry, I don't have that kind of money so I guess we will be going to court!

I am so angry that they are pulling this. We tried many, many times to find out how much to pay and now they won't work with us? What jerks!!!
