When charge glass of water plus tax must notify customer first

It is not right to charge a glass of water plus tax to an old senior handicapped customer, even there are small prints in the menu. We have been to hundred or thousands of restaurant during our life time here, we never know that glass of water be charge in California. The Restaurant has to notify their customer first to be fair.
