Hi here is my story for your files...
I had a small business (Computer repair) and needed a debit machine, I was given a sales man who was supposed to be fair, I ended up going with this company but when I found out how much more it costs to lease the terminal I decided to purchase the terminal. Not long after say under 2 years I was informed the my non “Chip” debit machine would no longer work so I contacted the company that sold me the machine, They told me that this machine was not” chip” compatible and I needed to replace the machine, They offered me $200.00 for the machine that I paid $1500.00 for just 2 years ago. The business was not going well and I could see that it would most likely close in the next year or so for this reason I was not willing to purchase another terminal. Approx 2 weeks later I get a call form a salesman offering better rates for my debit machine after a short conversation I found out he worked for the same company that I was using. After I explained my situation he stated the he would try to get me a machine that I could use until I closed my business all I would need to do it sign a new contract with the same processing company (they offer a $400.00 cancellation fee) I figured that this is the best way to go and signed the forms...
1 month passed and the machine never arrived so I contacted the sales rep. (Ryan Cooper) he started to bad mouth the company and had nothing good to say and warned me to avoid them “Like the plague” So when I asked “ where is the machine you promised for free” he said “ Let me see if I can get you one with the company I am now working for” Sure enough he called the next day with the “Good news” So again I signed and 3 days later my new “Chip” machine arrived. I used this for a couple of months and after reviewing my bank statements (I am a sole proprietor and do not check the bank statements very often) I noticed 1) Money taken out from the original debit processing 2) Money taken out from the new debit processing and 3) money taken out for “Equipment lease” when I tried to contact the sales rep. (Ryan Cooper) his phone was “Out of service” I tried to contact him with no results.
I contacted the original debit company and they told me I had to pay a “Cancellation” fee of $400.00 (I was never told of this nor did I sign this) when I asked what happened to “Ryan Cooper” They told me they fired him for defrauding there customers. I have now been in a battle with Northern Leasing over this fraudulent contract.
Here is what I have:
1) The contract was “Modified” after I signed the papers (Ryan told me that I needed to sign the lease in the event the machine was lost, stolen or damaged) He filled in payments term etc after
2) The machine was a “Cheaper” version than what was on the contract
3) Ryan was fired for misrepresentation and fraud
4) The contract they sent to me is different than the one I signed (Payments term etc. Filled out)
5) Northern leasing is supposed to “Call back” to verify I understand the contract which they did not
6) I have offered $300.00, $600.00 and finely $1000.00 to close the contract, I also in all 3 cases offered to return the machine
7) On Aug 8 (the first call) I stated I was misled and they said the would send me “Salesman misrepresentation forms” which were never sent
They have flat out refused to accept any offer other than the full amount
