On April 30, due to medical reasons I had to resign from my former employer. I contacted Bank of America on several occasions between now and then to inform of my change in income and to refinance my current loan (as the $1063/mo payment would no longer be affordable, and my credit score was still good at that time).in May I called into the auto loan customer service department to inform of the change in my work income. I was informed that my information had been taken down and my account would be reviewed and I would receive a return call once a decision is made. A month went by and I still heard nothing from the auto loan department. I was working at a summer camp to keep busy and was making $11/hr (coming from making a little over $50K/yr - including overtime hours worked). My payments began to be late and I started getting harrassing phone calls from Bank of America regarding payment, however still no phone calls regarding my information provided in May of my change in income and needing to refinance. On August 30, I began a term contract position with the Dept of Veterans Affairs in Columbia, SC (though a government position, locality pay for Columbia, SC was $22K less than what I was making at my previous employer).in September, I received repossession threatening phone calls from Mr. J. Vargas, demanding a payment of over $1500 or my vehicle would be taken from me. I had to use my whole refund check from my graduate school program (leaving nothing for buying books and supplies and putting me behind in my classwork) to make the payment. When I asked him about my May phone call regarding refinancing due to the change in income, I was again informed that my information had been taken and someone would get back with me. He was able with the payment I made to push my next payment back to November (and added the months on to the end of the loan), however, the note was still unaffordable for the money I was making and I still requested to have the loan refinanced.in May I had fallen behind, but with my income tax refund checks, and school refund check for the Spring semester, I was able to catch up on the payments. I called Bank of America in June to inform that I was still having hardship paying the note and the car's value had decreased, bringing down the worth of the vehicle.in June, I mailed a letter to the lock box address the customer service rep had given me for the submission of correspondences in Florida and paid for signature confirmation. It was received and signed for by J. Vargas (I still have the confirmation receipt). When I called to follow up on the letter, no one knew what I was talking about. I informed the reps that I had a signature confirmation receipt with a signature on it (J. Vargas) so the letter was received). On July 16, I came to DC for my grandmothers' 90th Birthday celebration party we had that weekend. While in DC, I went in to a local branch in Colmar Manor and had one of the bank representatives call and speak to the auto loan department regarding the run around I had been getting for over 1 year to refinance my loan due to financial income changes. The representative got a fax number to someone named Holly who was the account manager (as told by the auto loan rep to the branch rep). The branch rep faxed the documents and the auto loan rep confirmed receipt of the documents and the number of pages that were faxed and stated that someone would be getting back with me once a decision had been made.in August, my contract with the Federal Government was expired, however, I had been offered another position that is to begin on November 1, which I informed the bank representatives in recent phone calls for the past 3 months now and am even working a part time job that I began the end of September, but the note of $1063 is not affordable and it has been over a year I have been trying to resolve the matter. On Oct 9 my car was repossessed. I feel that I went above and beyond what the customer is supposed to do and I have supporting documentation and proof that I have been reaching out to Bank of America since I had to resign for medical reasons in April. It is now October and the only response Bank of America has given me is repossessing my vehicle for being late on payments that I informed them in May would no longer be affordable and the loan needed to be refinanced due to the car's worth. I would like for my vehicle to be returned to my possession and Bank of America fined for the lack of response I received from them for the past year and a half. The only calls I received from them were when my payments were late and threatening me with late fees and repossession threats. I want my vehicle returned to me, the loan refinanced, and the late payments on the account either added to the end of the loan or waived due to my ample notice to the bank regarding my income change in May and any marks on my credit removed with the 3 credit bureaus as it relates to my auto loan account from June to the current.
