Insurance company unfair conduct

In 2008 my family was rearend by a young driver the driver was drivung 50 mph and we were at a dead stop. Everyone had whiplash and back injuries, progressive rep offered $100.00 for the accident then mother died from injuries 2 yrs after fighting for her life died in sept insurance company waiting till the year changed two 2011 january and said since mother died all claims are closed
