Defective E-Flite blade SR out of the box

I bought a blade SR RTF from HobbyTown. The box was unsealed, almost as if someone had been through the box before. I took it home, charged the battery, performed all the pre-flight tests and tried to spin up the motor. The main motor was spastic at best and the tail rotor was stuck. I took it to the store today to get it checked. The technician claimed to have fixed the main rotor but found an issue with the tail rotor gyro. The store owner refused to give me a replacement that worked and asked me to leave the bird to have a different technician check it out. He also told me that the manufacturer warranties the product not them. I paid for a product that I wanted to use yesterday and I am stuck with it until the manufacturer fixes it and returns the product to me (I called the manufacturer yesterday and they have sent me a call tag for UPS to pick it up). I paid for a RTF (Ready to fly) helicopter not READY TO FIX. I should not be going through this hassle.
