I hired the firm of Manilahosting.com located in Manila, Philippines run by Mr Rick St john to build a database real estate website with SEO back in July.
In the beginning I tried to convey what I was looking for. I was asked to provide some example sites to give them a better idea of what my needs were and I did so right away.
Through several emails, I explained what I was looking for to make the site become marketable. A website was designed but did not meet my expectations.
I asked Mr St john to make needed changes. He made one or two changes but the site was never fully completed. I visited him again in person in October in his office. We sat down with his programmer and I again explained what I was looking for. I told him I really wanted it to be more of a site like myspace. He told me it would cost at least $1,400 to $1,500 more to have it like that and suggested I stick with the original design. I had to go along with it because I did not have more money at the time.
Since I hadn't seen any work going on with the site changes yet, and because I was able to make changes in my bills, I sent him an email asking him to go ahead with what we had discussed and I was willing to pay the extra money provided he would be able to meet a Jan 1st deadline.
The next day I received an email from him agreeing to change the format but he told me it would cost another $2,500 more. He said it was more than he quoted because I asked for some added features that we did not discuss earlier. I sent him an email agreeing to his price as long as he could meet our deadline and he agreed.
For some time I saw no progress so I emailed him more than once asking how it was going and if he would still meet our deadline. After a week or so he finally returned my email in large capital letters (meaning he was screaming at me) "YES WE CAN DO THIS AND YES WE CAN DO THAT AND YES WE CAN MEET YOUR DEADLINE".
When Jan 1st came, I sent him another email telling him he had missed the deadline. I wanted to know why he missed it. I asked him "Are we not important clients"? Right after sending this email, I sent another explaining that we were not trying to be mean, but we had an agreement.
He answered back that my letter was mean and nasty and he was offended. He said that he only said he would "try" to meet the deadline. He told me the 1st site "was" finished and he would finish the other one soon. I responded that the 1st site was in fact "not" finished and if he did not believe me he could go look at it.
I fully expected him to agree with me as the 1st site was clearly not finished. Many of the items still did not work. There was not even a sign-in. None of the changes were made that we discussed.in an earlier email he even said he had stopped working on the 1st website to start working on the second one.
I actually thought he was going to re-do the 1st site but later found out he made two sites. Neither of which was finished.
He then told me he did not wish to do business with me and when he finished the 2nd site we would part ways. He said he would now "not" host the site for a year as we had first agreed which meant I would now need to pay another company even more money to host this site.
He told me he would now not be willing to link my site to his 300 travel sites as he had originally promised. And we were not welcome in his office so we would not get the training that was supposed to be included in this package.
These were all the reasons we decided to hire him, because he promised all these things. Though we did not have a contract, if someone were to read all the emails between us, plus the receipt he gave us stating some of his promises, you can easily see that there was a verbal contract between us.
I told him that if he wanted to be like that, and reneged on all of his promised, then we did not want to do business with him anymore either. I told him to just refund our $5,500 we paid him through paypal, up front before the work began. He then told us that he was not going to finish either of the sites, and we could just talk to his lawyer. He then suspended our account and the sites, both of them, have vanished.
I got a lawyer but because I am working in Iraq and my fiancee is going to the USA soon on a K-1 visa which has a time limit on it for her to leave for the US, I'm not sure what the outcome will be. I may need to fly back to the Philippines more than once to appear in court.
I do not want this man to get away with stealing our life savings. There must be a way to punish him for his deeds. I am sure now, based on his actions, that he never planned to finish these sites.
What can I do? Who can I report this man to? Can he really get away with this?
