$5700 gone

I purchase a $5700 furnace from these guys and never heard back. When I called, I spoke to a russian guy who told me the furnaces had been discontinued and the last few were being shipped in and should arrive in about a week. After a week I tried calling again with no answer. I left messages and there were no replies. I sent an email and did get a reply to that. Here it is: Dear Customer,

I want to thank you for the orders you have placed with eComfortUSA.com now and in the past. It is with great regret that I must inform you that we will be unable to fill your current order. Due to a current situation with our payment processor unrelated to your transaction, they have wrongfully and illegally frozen all of our working capital. It is important to understand that you will get your money back.

This action has put us in the unfortunate position of having to cancel all outstanding orders. We have requested that they refund all money to our customers with open orders out of the amount they have frozen. However, the payment processor has chosen to deny this request without stating a reason or cause. At this point, I must inform you of the following: We do not have control of the funds charged to your card, so we cannot refund them directly. The payment processor, which does have control of the funds, has refused to refund the money to you. Our only recourse now is to take legal action against the payment processor. However, we anticipate that this will take months or even years. Therefore, our accounting department is advising that all of our customers with unfilled orders request a refund directly from their card issuer.
Once again, as the entity holding your money (as well as ours) has refused to willingly return the money, we recommend that you contact the issuer of your payment card and cancel the transaction through them. When talking to your card issuer, inform them that the merchant will not be able to deliver the goods to you due to a dispute with their payment processor. Because your card issuer has a greater amount of leverage over the payment processor, they will certainly be able to recover your funds. Sincerely,
Richard McLaghin
