Villa D'Este:
On Dec 19 I began moving out of unit 1404 which I lived in for one year. From the beginning there's been problems. The unit had a carpet in it that had been destroyed by the previous renters dog, there were urine stains soaked down passed the carpet and the padding. It took me 5 months of fighting to get the carpet replaced, at which time Sherman Williams came out and replaced the carpet with a stain resistant carpet the installers even poured bleach on the rug to show that the color was woven into the fibers so nothing could stain it.in the beginning of December there was very bad rains for about a week at which time my entire unit had gotten flooded. I called Michelle twice that day to report the damages and she informed me that this was an issue with a couple of the units and they had cleaning companies coming out to shop vac all the water out of the rugs, when I returned home it was the maintance guy that came in and ripped up the carpet in the upstairs bedroom and put a fan under it. The carpet never fully dried, There was no attention paid to the second bedroom, living room, closets or the walls. I recieved a letter stating that I was not getting my security deposit back for the following reasons:
-"$192.26 for the water bill"- i called nes and the bill is back charged for 2 months so that's correct
- "$100 countertop resurfacing - burn on backsplash".. That must of been from my toaster oven and i noticed it when i moved it out, they charged me to replace it
-"$50 for extra cleaning in the kitchen", i'm not sure what needed to be cleaned in the kitchen since i took everything out of it
-"$1097.14 carpet was replaced 5/09 and needed to be replaced upon move-out due to excessive amount of pet stains. This is charge for remaining 28 months of carpet life." the carpet was excessively stained when i moved in dec 31 and smelled of urine. I called them twice on dec 2 to report the damages 9:08am and 9:28am
-"$100 trash out neeeded in garage, kitchen, laundry room" when i was moving i called and spoke to michelle (who i spoke to through everything) and asked her where should i leave all the garbage when i move since they were unwilling to provide me with extra garbage cans and we didnt have a dumpster she told me to leave it in the gargage and thats when they would pick it up. As far as laundry room is concerned it was a washer and dryer in a closet and all it ever held was laundry, also the kitchen garbage once again was nothing and if aything should of been charged under the ridiculous cleaning charge
When i recieved the letter on Jan 13 I called Michelle immediately and she informed me that the carpet damage was from pet damage not the rain which is completely incorrect. I was never notified about any damage or a desire to show me the damage or recitfy the situation on my own. The pet damage claim is beyond ridiculous. I have a 4 pound dog and there was a non-refundable $400 pet deposit that was given during the initial move-in. If there was any damage it was due to their negligence in not providing proper insulated doors/windows and or not fixing faulty doors'windows and under the lease their negligence doesn't equate to their abiity to retain my deposit
Also, Michelle informed me that I never returned an inspection form upon the inital move-in on Dec 31 to which I never received and the office should of followed up on any such form. I've lived in many places and have never experienced anything like this and this matter needs to be addressed. When I spoke to Michelle on Jan 13 she stated that she would speak to Ramon the maintence man and call me back to which she never did.
