I was offered a position (salary) with Bailey Tool by the owner John Buttles and during the hiring process interview i was very specific and asked what the time requirements were for the salary he offered.

His statement to me via email was
"The position is 40 hours per week, however, there will be times when extremely busy where you will be expected to work OT, to be compensated in slow times by you being able to take extra time off"
What a JOKE!
Not ONCE did i work less than 40 hours! And was actually forced to work saturdays also.

I also negotiated 2 weeks vacation time annualy starting initially due to the fact that the company i was working for paid me 3 weeks vacation yearly.

2 weeks into the job i was sat down and told he expected 14 hours a day. His croney, Rich Easley, my new "immediate supervisor" told me he wanted me there 60 hours per week minimum.

Of course i refused and was immediately ostracized from the "TEAM".

I also asked about and was told that i would be given an annual review (you see, i have worked in salary positions previously and knew that if you didn't negotiate these items up front, the company pretty much could make you work into the ground with no increases in pay if they were so inclined) BUYER BEWARE TYPE STUFF.

During the next year i was still forced to put in WAY over a 40 hour week and when i asked for my annual review within two days my job was posted on the internet on monster.com.

When i confronted the owner about it, he deferred me to his whipping boy Rich Easley and i was told, You are now on 90 days probation, you have that 90 days to learn how to act like jesus, There will be NO increase in wages, and you are now salaried at 50 hours per week.

The work that i do involves ensuring that automotive components built by the company i worked for meet the design requirements on a blueprint (dimensions)

I have been repeatably asked during my tenure at Bailey Tool to "make the numbers good", in essense, that would be me falsifying documentation for parts that go in cars we drive.

The final straw was when Rich Easley told me he also expected me to make sure the numbers were "HAPPY" WHAT A F* (&ING JOKE!!!

I smiled and went out looking for another job. Within 2 weeks i found one and went over and above any requirements to ensure Baily Tool was not left in a bind, I gave 13 days notice, I offered to train anybody in the company to perform some basic functions until they got the new programmer up to speed, i even interviewed my replacement!

I was told by the company officer, (which i believe she will be fired for doing) that it was dependant on John Buttles mood and that there was no policy regarding vacation time payout when leaving the company (voluntary quit), sometimes he approved it and sometime he didn't. I asked what i needed to do to receive the two weeks I had coming and she said she had to get approval from Rich Easely, an hour later i went back to the front office and asked her the status of her request to Rich and she told me " the checks have already been put in for", well to any sane individual, you would think thats that.

I've given my notice and they are being OK about it.

I work for the next 12 days and when the checks come in 1 day prior to my last day, i am told, "John Buttles said you didn't earn your vacation time pay, that it is company p[olicy to pro-rate vacation pay"

I ask Rich Easley why, by ommision (apparently JB had told him this a week ago), he let me believe i was going to receive the vacation pay, his response was "i'm sorry" (he was just trying to keep me there to get more work out of me until the replacement started).

Well finally i told them both that it wasn't my fault there was miscommunication between them and if i wasn't going to receive the vacation pay, i should have been told when they made the decision, and that if i didn't receive my vacation pay on my last day i would go to every agency state and federal and report thier unsafe, unfair, nasty working conditions.

John Buttles actually had the gall to tell me this was extortion, and that he would take me to court, he then offered and withdrew what he reffered to as a "grant" just to shut me up (but thought better of it, called it blood money), he also said that if he paid me the vacation time, then he was setting a precedence and would have to pay ALL employees who left thier vacation time and this was the main reason he couldn't pay it to me!!! I'm thinking... Duh, if the understood. Unwritten policy is you get your vacation time on your anniversary, them anybody that leaves is ENTITLED to receive it. Its not my fault you are in a financial bind, and don't try to save a few bucks by denying me what i earned.

Finally, the was TOTAL ADMITTANCEeeeee on Both thier parts JOHN BUTTLES AND RICH EASLEY that if i had put in for two weeks vacation on the 4th of july, (when my anniversary was) i would have recieved it. But since i quit i don't deesrve it!!!
