I entered into a contract with the Dolce Living on November 15th for a new duplex to be built. I paid $5,000.00 up front which was to be refunded back to me, per the contract, when the property receives the Certificate of Occupancy.
Turns out my income would not allow me to qualify for the loan. Some creative documents where drawn up and a HUD1 was fabricated to show the bank I had the funds available. I made a phone call on Wednesday, November 22nd and I expressed my concern over this and was advised that this is standard procedure. Being uneducated in the home buying process, I took the professionals advice and moved forward. After all, they do this for a living and should know better so why wouldn't I believe them?
A construction loan was drawn up, using my name and credit. As per the contract, dated November 15th, the Dolce Living was to make all payments until the property received the Certificate of Occupancy, at which time I would be refunded my original $5,000.00 deposit, as per the contract dated November 15th
Fast forward to 2009
I am notified from the Bank on February 4th that the Dolce Living stopped making payments as of November. Clearly a breach of contract. The property is far from complete. I am also realizing that it should have been built and occupied two years ago. Why cant Dolce Living finish this thing?
From February until August 11 the following has occurred.
Dolce Living is in business, and have severed contact with me. On August 4th a temp CO has been issued. The property is still not complete. And because Dolce Living has strung this out almost three years. The property has mold issues. Dolce Living refuses to move forward to completion.
Since August 4th,15 un returned phone calls have been made regarding the $5,000.00 I am due. I have been informed by an employee at Dolce Living that I will not be getting my $5,000.00. No reason, no explanation.
This is only a brief summary of my overall experience.
