Judge Fahey, of the Los Angeles Superior Court, is the type of judge recently decried by Justice Antonin Scalia. Judge Fahey has spent his entire career in government service and is without real world experience.
This makes him unsuited for considering many civil cases because he simply does not understand how things work. This creates a difficult situation for litigants, especially those who have complicated facts involving fraud, breach of duty, etc.
Moreover, Judge Fahey arrogates to himself the authority to make rulings on questions of fact, questions are supposed to be left to the jury. This denies plaintiffs their day in court and a shot at justice.
