Today I received a call from "Alex" who is an "associate" with Riddle and Associates who advised he was "collecting a debt" and all information collected would be used for that purpose. I inquired as to whom the money was owed, a medical provider, and what was the date of service and amount. Imagine my surprise when I was advised the date of service was 1995.in Virginia, 3 and one half years is the statute of limitations for civilly collecting a debt.
I advised Alex that his call was 12 and one half years too late, requested he have no further contact and went on to explain that because we had changed medical insurers and the "one year" allowed to file claims was long gone, there was no way I would agree to pay the bill.
At first, Alex freely advised they could not sue or report to a credit bureau. However, after repeatedly advising him that he was to have no further contact at my home phone number, he advised "collection action will continue and we will sue".
It is my intention to advise "Alex's" supervisor and the Utah Bar Association as well as filing the formal cease communication notice.
