This collection attorney has filed a suit against me for a repossessed car's deficiency balance. The repossession occured in Oct, it has been far beyond the SOL for a deficiency balance. The repossession happened while I was living in Florda, and now I am being sued in Georgia. Anywho
1. Never ever recieved any letters, calls, emails, etc...
2. A deputy shows up at my door one night with the lawsuit
3. Filed my answer (SOL OCGA 11-2-725 & Right to Redeem OCGA 10-1-36)
4. After 4 months of nothing I recieve a "Motion for Summary Judgement" which goes on to say in section II that "Plaintiff has pierced defendants pleadings, and is entitled to summary judgement".in the whole 15 pages there is never one mention of the SOL defense I claimed. Only evidence to prove they sent the letter on October 15.
The paperwork I recieved doesn't say if it was filed with the clerk or just sent to scare me. So I have to track the Clerk of Court here down and find out the status of my case.
5. What do I do now?
