In this company served papers to my home for a credit card account with Harvest Management. My wife contacted them to let them know that this was not my account. They said it was. She asked for proof of this and was told that they did not have to prove it.
Fast forward to April. I received an order of judgement against me dated March 17. I was never notified of the March 17 court date. I had no idea they were going to court to get a judgement against me since we had not heard from them from 2007. My wife once again contacted Suttell and Associates. She again told them it was not my debt. Once again they said it was. She said she wanted proof of the debt. They again told her they didn't have to prove anything.
April 24 I received a writ of garnishment from Suttell and Associates that was dated April 7th. My wife and I went to the courthouse to get information about the judgement and to check into having the judgement overturned.
We went through the file of the court case. Suttell and Associates claim they served my wife with papers in May. They do not have a signature from my wife. Their process server wrote a description of the person they left the papers with. The process server says it was my wife. But, his description of the person does not match my wife. The person he left the papers with is over 4 inches taller than my wife, 70 pounds heavier, and 4 years older. I do not who this person is that they say they left paperwork with.
I have disputed this credit card account with the credit reporting bureau. I sent a letter to the court and Suttell Associates along with the writ of garnishment exemption letter. This letter included all of the information regarding the dispute with the credit reporting company.
On April 29 I received a letter from Suttell Associates stating that garnishment would begin on May 15.
I am at a total loss as to what to do about this. They are garnishing my wages for an account that isn't mine. I do not know what my recourse is. I am hoping that the court will see that this is not my account but I don't know if they will.
I thought that I would have to be notified before a court date, but I wasn't. I thought you had the right to defend yourself in court, but I guess you don't.
I would like to hear from others and see what their experiences have been. Maybe together we can stop this company from doing this to others.
