Promised merchandise to stuff, but never came through and ripped us off for $35.00... Why doesn't the State of California prosecute this company, as I have seen ripoff

I had a "hunch" about this company and decided not to send any money, but I would like to know why the State of California does not prosecute this company? I used to live in California as a court reporter for 19 years and I am sure the Consumer Protection Bureau can do something about this...
