Failure to return deposit

Sent check to Carving Station in July for $275.00 (Gareth Jones, Mgr.) to reserve a private room for a wedding Rehearsal Dinner for my son. We decided on the room and the menu so I sent check and signed contract. On Oct. 21st Mr. Jones informed me I could not have the room because he was bringing in enterainment to help increase business and it would be to noisey. He tryed to get us to use the patio outside but I was afraid of weather issues on Thanksgiving weekend so I declined. He told me to try and find some other place for the event he would not be able to have it inside, he also informed me they were changing the menu and the style of serving ithe food also. It took a lot of time and effort to find a new location on such short notice but I finally did. I called Gareth and told him and he said he would send me a refund check by the end of the month. I never got one. I've called several times, he quit taking my calls. I've sent e-mails to no avail. I've sent a Certified Letter to the owners which came back unclaimed. The cancellation date on the contract is 10/28/08. This was well before then & he's the one who broke the contract by not providing me with the room we agreed on and the style of food service and the menu.
