Complaint / Review
Countrywide Mortgage
DO NOT GO WITH THIS COMPANY Calabasas California

To Whom it May Concern,
My husband and I purchased a home on December 12 in Simpsonville, SC. Our home was through Security Finance, but switched to Countrywide Mortgage within two weeks of owning our home. My husband suffered a heart attack resulting in our inability to make one month's payment (March). I notified Countrywide immediately and discussed this with Henry (countrywide associate) who informed me that everything would be okay, just to add some extra money to our next payment to pay towards our debt.in his words one payment was not much.

My husband is a police officer for Fountain Inn, SC and while he was attending the Police Academy from May 19th to August 19th he suffered another incident with his pace maker. My husband is only 28 years old, veteran and current police officer and has already sustained a heart attack due to Coronary Heart Disease, stent and a pace maker. During his academy stay, his pace maker malfunctioned and caused his heart rate to escalate to 145 beats per minute for three weeks straight, as you can imagine this caused substantial damage to his heart. He was sent home and hospitalized from June 10th for over a week.

My reason for writing you is that Countrywide Mortgage will NOT work with my husband and me on any forbearance, workout, loan modification, FHA Grant or any other type of program. I was only one payment behind, and then they stopped taking payments completely. They refused my August, September and October payment stating they would take the payment, however they would hold it into a suspense account for thirty days and then mail it back to me.

I have spent over 30 hours on the phone with Countrywide and cannot get a straight answer that doesn't end up contradicting itself later. I have been hung up on, lied to, cursed at, called a terrible person because I am behind, harassed about making a payment they will NOT accept. I am lost and I have absolutely no idea what to do at this point. I am going to attach a summary of my latest calls, but one particular incident happened just recently.

I contacted the FHA Hope Center because I have a FHA, 30 year fixed mortgage. I spoke with Pat Brown (Nova Debt) who informed me that Countrywide had to help me in some way. She said that because I was four months behind they should let me use the FHA claim to have FHA step in pay my loan current, attach it to the end of my loan and I would start paying the FHA back either after the mortgage had been satisfied or the sale of the home.

So, I called Pat Brown (Nova Debt) and she conference in Mia with Countrywide Mortgage on October 6 at three o'clock. Mia said that they would NOT accept payments, partial payments or a plan until the entire past due balance had been paid. Mia then argued with Pat Brown (FHA) about the criteria for the FHA claim and said that countrywide had their own personal, rules and guidelines for someone to qualify for this plan. My husband and I have over 50,000 dollars medical debt. We can make our monthly payment, but cannot afford to add an additional five hundred dollars per month to this payment, which is the only thing that they have offered so far.

I have sent in my hardship letter, financial statements, and doctor's bills, affidavits from the doctor, budget and copies of pay stubs. I have applied for the workout departments in regards to a loan modification or a forbearance plan. I was lied to several times and told I was not approved, then I received a certified letter in the mail stating I was approved for a forbearance plan, but if I did not send Countrywide one thousand dollars in five days and add an additional four hundred dollars a month to my payment for the next thirty months they would be unwilling to help me.

I called them for ten days straight and was told that I did not have a negotiator, the name Linda Smith (negotiator) was not there, unavailable, did not take calls, could not help me. Then on day ten after investing over 12 hours trying to locate this non-existent person she told me that she could not discuss this with me and that the deal was the way it was. She told me that I had six hundred extra dollars a month left over and that should be plenty enough to make the additional payment. The six hundred dollars, was in a negative bracket not positive, which I resent to her and then she said I was denied at that point. She (Linda Smith) informed me to call back to the Customer Service department and set up a workout plan. I called back and did just that.

I set up to send one hundred dollars extra every single month August through January and when my husband and I filed our tax return, we would be paying off the remainder of our debt to them. The lady that I spoke with at Countrywide (Gina) informed me that this plan would indeed work and to just call back in next month and make my payment. I called back in on August 1 and was informed that they would NOT accept my payments. I have no idea what to do at this point.

I contacted IMC Financial, a mediation team that will go in and talk on your behalf negotiating with your lender to get them to work with you. I have heard only that Countrywide was hoping to get as many foreclosures under their belt as they could so that they could get bailed out. I was told to contact the Attorney General's Office in CA to see about pending cases. I did and attached is the lawsuit I got back.

I need help through South Carolina. My uncle Mike Pitts, House of Representatives and I am sending him this letter as well. There has to be some type of help for people having this type e of abuse thrown at them when they are clearly in need. The last call I made to Countrywide was on October 15 trying once again to work something out with them and they were unwilling to talk to me, negotiate or extend any type of plan to help my husband and me. I feel that it is ridiculous for them to stop taking payments. I expressed to Mia (countrywide) and Pat (Nova Debt) that if they had of worked with me when I was one month behind I would be okay, but because they have ignored me, refused to talk to me, accept payments or any other type of help I am now four months behind and will more than likely be served with foreclosure letters.

You would think with my husband serving for this country during war, and being an active Police Officer putting his life on the line every single day having a heart condition, you would think we could get one person to assist us.

I have no idea where to go or what to do at this point. I am completely lost; please guide me in some type of direction. I know that CA has a case pending to where the consumers will be receiving $27.9 million dollars in settlements due to Countrywide refusing to help consumers and foreclosing on their properties. It also states that this lawsuit is adjusting interest rates down to a range of 2.5-3.5% to assist homeowners regain establishment.

If you Google countrywide mortgage, you can see just how many hundreds of people who are in the same boat as my husband and I. Please give us some light on this and possibly a direction to take to make Countrywide, stop building a brick wall towards its consumers.
Thank you for your time,

CC: Mike Pitts Representative, South Carolina State House of Representatives
Edmund Brown CA Attorney General
Enclosed: Two Countrywide hardship letters, Attorney Generals Letter regarding lawsuit.
