Cannot cancel via phone. Explanation of cancel procedures not specific in booklet provided nor is address to return product

I signed up for the warranty on 13 Jun. The downpayment on this warranty was $395.00.

When I received the product and warranty booklet, it indicated there would be a lien placed on my vehicle. There were many condition that were required of me to keep the warranty inforce that had not been explained to me on the phone. There were hundreds of items that the repair warranty would not cover.

They sold the payment contract to MEPCO Finance Corp, P.O. Box 5978, Carol Stream, Illinois 60197-5978. (800) 397-6767.in addition to the downpayment, payments were to be $136.33 for 12 months.

The product was received on 23 Jun. I wrecked the car only 5 days after receiving the booklet and the MARARHON DURA LUBE oil product. I decided I would not keep the car after it was repaired. I examined booklet for cancellation information. There was reference to sending the product to the ABOVE address. There was no address at all on that page or in that paragraph.

I called and talked to a customer service rep named Damon Hinson. I asked why the lien, and he said none would be placed on the vehicle. I then stated I wanted to cancel due to wrecking the car. He said if it was not totaled out, that I should keep on paying for the warranty to have GREATER value in the car for a trade or sell. This is not true, because it would require an additional fee for a transfer.

I asked for an address to return the product. He told me to find the address on the back outside cover of the booklet. The printed cancellation instructions did not tell me to provide a letter giving a reason for the cancellation. It did show that they would keep $75.00 as a cancellation fee.

I mailed the product back to them on 3 Jul. Thankfully, I also called MEPCO finance company on that date and told them to stop monthly draft payments from my bank.

On 7 Aug when I had failed to receive a refund check, I called and talked to again to Damon Hinson. He said they had not receive the product and the letter. I asked "What letter?" I told him to find the product because I had insured it with the post office.

On 14 Aug I called and was told they had received the product on 8 Jul but no letter was included or sent. He said I would not be refunded $320.00 (leaving them a profit of $75.00) because it was now past the 30 day return limit. I asked didn't they have a record of my telephone calls. He said yes, but you couldn't cancel via phone and they could not cancel without a letter. After I told them I was reporting this to the Better Business Bureau and that my lawyer would be contacting them, I asked to speak to his supervior.

Someone named Jermain/Germain came to the phone. He told me there would be no refund because the time limit of 30 days was exceeded and no letter had been received. I asked could I still send the letter since they had the product. He said there would be no refund even if I sent a letter. So why would they accept a letter now?

Since my contact with the MEPCO Finance Corporation, they have sent me reminders to make payment, that payment is overdue. The last one dated 4 Aug that they intend to cancel the Service Contract on 24 Aug.

I am wondering if SAFE RIDE WARRANTY is just stalling until MEPCO does this cancellation to really cement that they do not have to refund my downpayment, less their $75.00?
