FDIC said my assesment was right CALL the FTC to report them

Olks here we go. I was just curious w things dealing with UCL and low and behold I find the FDIC website and read the breakdown for payday lenders.

I send an email telling them about and how theyre under the Miami Nation and I was told that they are under federal jurisdiction (even though they are a tribe) and I should register a complaint with the FTC.

I have seen many people say that here but my story continues... It appears that the Modoc Tribe WAS they owners of MTE the head of all the payday loan companies that UCL has been associated with. It appears that they merged enterprises with the Miami tribe and that the Miami tribe is now taken over all the payday loan operations (not a fact just drawing a conclusion).

This is the email I sent to our the Oklahoma State Department of Consumer Credit when I found that one of the MTE companies (Rio Resources) had been hit with a C&D it is my understanding of the law that if these companies are "chained" an issue for one is an issue for all.

"It has come to my attention that there is a terrible stain on the State of Oklahoma. It's name is United Cash Loans. It is my understanding that this payday loan company has been ripping off the consumer for the past three years. I was very surprised to learn that your offices had issued a cease and desist to one of the does business as company Rio Resources.

Although this company was doing business under the Modoc Tribes address it seems that since the merger between the Modoc and Miami Tribes for the Stables casino there is a little double dealing going on. Although they will not release the information to it's consumers it seems the Miami Tribe is representing itself as United Cash Loans (along with several other payday loan companies) and the address for United cash Loans is that of MNE (Miami Nation Enterprises) and MCA (Miami Collection Agency). They DO NOT represent themselves as a collections agency in phone calls and letters. They represent themselves as the payday loan company they claim to DBA.

They claim that they do not have to follow any regulatory rules as they are part of a tribe and on tribal property therefore sovereign and not held to State of Oklahoma (or any state for that matter) or Federal regulation. They claim they are licensees to practice in whatever state they want because they are an internet company. However, if you check the by-laws of the tribe they do state that they do fall under federal law. Your offices has sent a C&D along with the State of Maine and the State of California has also released a C&D (but because the address on that C&D was in New Mexico where this company has allegedly moved from to Miami OK it may be judged invalid because of that error.)

It is my understanding of tribal law that this company must be in trust to the tribe. Also they fall under they supervised loan law due to their enormous APR and fees not a Deferred Deposit Loaner as they are putting themselves forth as. Per your letter to Rio (which is a company under United Cash Loans) you dun them for not being a licensed lender and advise them under section 5-202.2 of the UCCC that by violating this act (Section 3-502) the loan is null and void and the debtor is not obligated to repay the loan AND that if the debtor has paid any of the principle or loan finance charge that he/she is entitled to recover the payments or enforcement of rights arising from the debt.

Question #1: Has the Miami or Modoc tribe been given Supervised Lender License status? If so when?

Question #2: If the State of Oklahoma cannot stop these people from ripping off the public as a whole and bringing down the status of our state and the American Indian people can the Federal Government do something?

Question #3: Can you not shut this company down? The collections part I understand as a business and recognize that as a part of their enterprises, but to claim and do business as a lender and to put so many people into further debt and cause them greater anguish and suffering is wrong and if it was any other lender besides someone doing business on tribal property you would be throwing the book at them. As an American Indian I am ashamed at the practices of this company and how it makes native people look as though they are making the white man pay like he made us pay. If I am in error of any of the information I am writing about please forgive me and disregard this e-mail. However if I am correct in any of my theory please know that as a taxpayer and citizen of the State of Oklahoma I will expect you and your division to uphold the law to it's fullest extent against this group.

I also have a copy of the D&C letter the state sent to them

If the FDIC says we have a case and to contact the FTC thats what I am doing.

If all of us would do this maybe someone will sit up and pay attention.
