Buyer Beware

I got ripped off from the door-to-door meat guy and I wanted to share the letter that I sent to the owner of this scam company.
The short story... I bought meat... I immediately stopped payment on my check and ask the company to come back and take the meat away... They refused and turned me over to a collection agency.
They didn't provide me with the necessary information regarding my rights as a consumer.

Mr. Montague,
On April 16, I was approached in my home by an overly aggressive, forceful and very belligerent salesman who identified himself only as Louie the Meat Guy He said he had some left-over meat products and asked if Id be interested in purchasing some product. I thought he might have a couple of steaks, as thats what he led me to believe.instead, he walked into my garage (uninvited, I might add) and spread out several packages of steaks and chicken. There were two other guys with Louie that made me very apprehensive and somewhat uneasy. Suddenly, I felt very uncomfortable and vulnerable in my own home. These guys were never invited into my home or garage and I at no time was interested in purchasing several packages of meat!

After saying no to Louie numerous times, it became obvious to me that he wasnt going to go away. Every time I said No he became more insistent and forceful. It was only then that I wrote him a check for $325.00, knowing full well that I wasnt going to keep his meat products. Mr. Montague, I know that there are laws protecting me from these types of situations. I felt that this was my only option at the time; write him a check to get him and his cronies off of my property.

As you should know, The Federal Trade Commission's (FTC's) Cooling-Off Rule gives me three days to cancel purchases of $25 or more. Under the Cooling-Off Rule, I have a right to cancel. The Cooling-Off Rule applies to sales at the buyer's home and applies when the salesperson makes a presentation in my home. This is exactly what transpired on April 16.

According to the FTC, under the Cooling-Off Rule, the salesperson must tell me about my cancellation rights at the time of sale... Louie made no mention of these rights. The salesperson also must give me two copies of a cancellation form (one to keep and one to send) and a copy of my contract or receipt... He did neither. The contract or receipt should be dated, show the name and address of the seller, and explain my right to cancel. Louie the Meat Guy simply left me with a tri-fold, advertising a business that contained a web address that was non-existent.

The fact is; I do not have to give you a reason for canceling my purchase. I have a right to change my mind. I stopped payment of my check.

I immediately contacted Omni Distributing in El Cajon and told them of my decision.in fact, I made no less than 7 attempts to have Louie the Meat Guy come and get his product out of my freezer. Every attempt to communicate with your company has been met with arrogance; one call after another. Louie the Meat Guy is never available and calls to your Phoenix location, speaking to a lady named Denise, were handled very unprofessionally and amateurishly.in fact, Denise basically said that I was stuck with the meat and said that there was... Nothing that you could about it... Her unprofessional response confirmed my suspicions; I was, in fact, scammed by Louie the Meat Guy and Omni Distributing.

Im wondering if you are aware of the tactics being used by these so called salesmen representing your company. None the less, I know my rights and will do what ever is necessary to either resolve this situation amicably, or bring attention to the method by which you do business with the local media outlets.

I vehemently dispute the actions of both Omni Distributing and Certegy Check Services, the agency you turned this over to in an attempt to recover fees that are disputed. If Im harassed anymore by Certegy Check Services or Omni Distributing, I will have no choice but to contact The Federal Trade Commission.

I ask that you have someone from your El Cajon facility make arrangements to come back to my home and take back your product that has been sitting in my freezer for a month. Preferably... NOT Louie! I havent touched the meat since it was placed into my freezer on April 16th. My hope is to resolve this matter reasonably and quickly.

Don't be a victim of this scam. Don't ever buy a thing from these thugs! Let's put this kind of business... Out of business!
