$80,000 over charge... Not taken off my credit report

In May Capital One put a fraudulently charged $80,000's to my credit card. I found out when they called me demanding payment. I had yet to receive a statement. I told them that was not my charge. They would do nothing told me I had to go to the convenience store where the charge supposedly occured. I went there and they were nice enough to let me go through all their financial statements and receipts for that time period. I spoke with the gas company as I had purchased gas on the day in question. The gentleman at the gas company told me what to do.

I kept calling and digging up numbers and ended up talking to someone in the corporate offices. They kept insisting it was not there fault and there was nothing they could do about it. They finally admitted verbally that the charge was an error. (They had been telling me that I had to get the money from the convenience store to give back to them). I was also informed that the credit reporting agencies had been notified. They also told me that they would take it off.

Well that was almost 4 years ago. It still shows high balance $80,000's. It does say account was closed consumer request. But they are causing me problems when trying to get a loan. I need this taken off it was not my charge. I even filed an identity theft report at the time. Unfortunately, I do not have any of the paperwork from 4 years ago as it was all lost in a fire.

The bottom line is I had a $300 credit limit. They had to know there was no way that and $80,000 charge should have or could have gone through.

I asked to speak with the President/CEO Mr. Richard D. Fairbank - I was told he doesn't take calls and the person I was speaking with only had limited authority.
I filed a complaint with equifax. Apparently they have contacted Capital One and yes you have it they are denying and refuse to take it off. I am willing to join in a class action suit against them. I had to have my sister take the loan for my computer because I was turned down due to the high balance of $80,000's. It is still there and needs to be off. Is there anyone I can report Capital One to for Fraud and Identity Theft?
