Huge Anypets.com A/k/a Any Pets Inc & James Schwinn A/k/a Michael James fraudulent misrepresentations in connection with on line purchase of bogus pure bred Pomeranian Ripoff Lauderhill Florida

This has been my experience:

Back in the beginning of April, we saw a picture of a 10 week old Pomeranian Puppy at anypets.com (CB34267). On April 11, we purchased that puppy through Stuart Hirsch, one of Anypets.com's representatives. Six weeks later, when our puppy arrived from Louisiana, I questioned not only his coloring but the length of his fur. He is supposed to be from a champion bloodline and came from a breeder in Rayville, LA called Little Paws Kennel. I called Anypets and spoke with several individuals - starting with Jennifer Spakes as well as with Marlene Martinez. On each occasion, I expressed my concerns as well as to the breeder, Rhonda Weems (aka Rhonda Wallace) and was told he was a purebred Pomeranian and that his coat will take awhile to grow in.

Now it is 4 months later and the puppy looks nothing like a Pomeranian. The breed standard is 3 - 7 pounds and he is 9 pounds. He was supposed to be an orange sable color but is tan with some white. He also has a very short coat and looks like a corgi - not a Pomeranian. My veterinarian and two local Pomeranian breeders doubt he is a purebred Pomeranian. I have contacted several people at Anypets demanding a refund and they refused. Marlene Martinez, Customer Service Manager, of Anypets.com told me the best that can be done is to send me another puppy - I could keep the one I've had for 4 months. I told her I did not want another puppy to raise. Her response was I could sell it if I wanted. She told me there was no way I would receive any refund.

I have also been in contact with the breeder, Rhonda Weems (aka Rhonda Wallace) at Little Paws Kennel in Rayville, LA. First she admitted to me that my puppy who was sold as a Pomeranian did NOT come from her kennel but from her aunt's and that she could not guarantee that he is a Pomeranian. Rhonda also divulged to me that in April, she received a phone call from Jennifer Spakes at Anypets asking Rhonda whether she had any Pomeranian puppies available. Rhonda told Jennifer she did not but that she MIGHT know someone who did. Rhonda then admitted to me that she doesn't know what happened. She said perhaps her aunt did not supervise the dam and that she mated with another dog. Rhonda said she kept Brutus' sister (from the same litter) who looks like a Pom. Her explanation is that a dam can carry puppies from multiple fathers and that maybe Brutus' mother was not supervised carefully and is possibly part Pekinese. Rhonda then offered to send me a replacement puppy. I told her it's been 4 months we have bonded with the puppy we received and that is unacceptable. I am demanding a refund.

As I researched Anypets and the General Manager's name, Jordan Blum, I discovered others who have similar complaints. Then - much to my surprise - I came across several interesting articles involving General Steel Domestic Sales, LLC d/b/a General Steel, and Capital Steel Industries, LLC d/b/a Capital Steel.

It is unthinkable that Jordan Blum ve engaged in and been penalized for participating in consumer fraud and deceptive trade practices, and yet continues to do so. Nearly all of the published complaints about Any Pets, Inc. Are from 2006 - present, when he joined as General Manager. Anypets.com engages in activities which advertise and market puppies that don't exist. They also substitutes one puppy for another which is deceptive, fraudulent, excessive and blatantly illegal. There are numerous others, both consumers and breeders, who are looking for recourse from shipping sick pets; shipping different pets than the ones selected from the website; misrepresentation of facts regarding the pets' origins; and failure to stand by its guarantee, who have been duped out of thousands of dollars.

I have requested that I be fully reimbursed the $1284.00 I was deceptively charged or I will pursue legal action.

In addition, I have contacted the consumer fraud department of Miami's NBC affiliate, TVJ. I am sure the television stations and newspapers in South Florida will be interested in this story, given the numerous complaints posted on various websites regarding anypets.com's unlawful practices.

Anypets.com has engaged in fraudulent and deceptive business practices. I have filed complaints with the Florida BBB, the Florida State Attorney General, The Florida Department of Agriculture, the Broward County Bar Association (for a lawyer) and the Louisiana State Attorney General.

Simply put, it will cost Any Pets, Inc. Much more than $1284.00 to defend what promises to be class action litigation and potential criminal penalties. I look forward to hearing from you.
