I was a new employee (5 days new) of Holsum bakery in Phoenix AZ, On the fifth day of work my elbow started to swell and hurt. I reported it to my direct team leader, she said I should go to the doctor I said okay. (By the way I worked night shift from 930 pm to 600 am) this was reported at 1100pm on a sunday night. I also showed it to another team leader at 200am and he said the same thing I should go see a doctor and that I would be reprimanded if I left early to go see the doctor and I should wait until the end of my shift.
When my shift was over at 600am monday morning I filled out an accident report and my team leader said I need to go to Concentra to see a doctor, I said ok. I left work and went with my wife to some appointments and then around 230pm monday afternoon went to concentra, I waited at concentra for 6 hours to see the doctor. I was released from concentra at 700 pm Monday night.
On Tuesday evening I reported to work at 930 pm and was told I had been terminated because I refused to get treatment!!! My superviser said "what you have the paperwork to prove you went right here?" So the next day now Wednesday morning I called the HR department and tryed to get some answers and no one really had any definate strait answers for me, I left several messages throughout the day and never recieved any response back. I also got a copy of an interoffice memo stating the following
" XXXXXXX says paperwork already in your box up front. Apparently the guy was hurt on the job and would not report to Concentra for medical attention (Automatic termination) per xxxxxxx Just goes to show you doesn't it? Reply from xxxxxxxx Wow!!! Everyone was so excited about him. What happened? Please send paperwork and documention.

I never recieved any notice that I needed to go immediatly during my shift or directly after my shift, I was told go today to Concentra to see the doctor. So basically while I was waiting in the dr's office I was being terminated. No one called to see if I was at the dr's or anything, I didn't even recieve a call to let me know I was terminated they let me show up the next day to be humiliated.
I find the memo to be very offensive, what does "Just goes to show you mean?" Not only that statement but other racially charged statements were made throughout my employment. I was told by other employees to watch my back because covert things happen. A union representitive pointed out that the blacks are segregated and not allowed to work in the same areas together. Either I was fired for being black or for being injured on the job. Either is wrong!!!
When confronted the superviser in HR had no real reason other than the excuse that I should have left immediatly right as I made the report and went directly to Concentra, this was never made verbally or in writing clear to me in any way shape or form. No supervisor or team leader ever told me to go now or immediatly, there are no policies in place stating a time limit to which I needed to report. I feel like the same day was a timely fashion.
I am a good employee and the staff were raving about my job performance so why am I being terminated becasue of others lack of training! If my supervisors didn't notify me of any time limits am I supposed to be a mind reader and know these things. I have never filed a workers comp report before how would I know the regulations, isn't it the employers job to notify me of any time limits or constraints? I wasn't even given any paperwork or maps of places to go. Nothing!!!
I am outraged at the treatment I have recieved at this facilty, they called me 3 times to make sure I was showing up for orientation, but not even once to get my side of the story or to tell me I was terminated.
Holsum is a family owned operation and prides itself on its so called fair treatment. What do you think is this fair treatment??
