My family had rented a house from Beven and Brock from july 1998 through september. Upon moving in the property landscaping was filled with debris, filth, rodents and rubbage. I was promised that the yard would be cleaned up. This never happened.
During our 26 month occupancy we were denied repairs in timely manner such as beven and brock was informed in june 1998 that our heater did not work and the gas company would not lite it until it was fixed, they did not fix it until october 1998. I also had fleas from the dog of the prior tenant and my kids were severly bitten, and it tiiok Beven and Brock almost six weeks for the pest control to come out and spray. We also had rats for three months and i had to call the health department twice.
They told us to buy some rat traps and ant spray. Well if that was the case than why didnt the exterminator get rid of them after seven visits and trapped three rats, It was not until a palm tree that needed to be cut was cut. Also the yard i landed up cleaning myself with no help from Beven and Brock. Here is the best part, in august we were given a 30-day notice to vacate, not an eviction, in california a landlord can ask you to move with cause.
We were never late with the rent once. This was due to the fact that i had held them accountable for there lies and lack of proper maintance. The health department made them take care of the issues needed, Keep in mind that this house is a duplex and in a fairly nice area which was a nice place, except for the fact that Beven and Brock along wth the ownwr Janet Condie, let the place go to HELL.
E moved out september 20. Six days over our 30 days. The california civil code 1950.5 tates that a landlord is to supply the move out tenant with an itemized dispositin and or remainder of security deposit back, with in twenty-one days from execution of move out. This is the really good part, on october 11 which was our twenty one days, we still did not have this disposition. We had sent them a letter certified october 16 demanding that we get this from them a.S.A.P.
The responce we go was a little memo no bigger than a mid sized post it note, letting us know that they were waiting for estmates and invoices. We did not here form them again until january 19 four full months after we had moved with a disposition that was written in chicken scratch with a pen. This disposition told us that we would not get our security deposit back of $895.00.
The best part is not only didi they keep our security deposit but they were demanding that we pay an additional $1692.00 for landscaping and if we didnt pay it that it would go on our credit in thirty days. I told them that i was not going to pay, because what Beven and Brock did represnted by the manger Jana Norris Brown, along with the owner Janet Condie, was they had upgraded the back yard with sod grass, shrubs and a new sprinkler system which they had spent $2000.00 and wanted to charge me for it.
I told them i would not pay to go a head and sue me. Lucky for me i had viedo for this which showed the before and after, i did not destory the yard. Three four months went by i heard nothing from them, what i had done in june is sued them for $2000.00 knowing that i would win nothing but my goal was to get them to counter sue me for the $1692.000 lie they accused me of so that i could bring closeure to this issue and not to have it on our credit report. Unaware that it was alredy on our credit report with out any body questioning it. He was the judge in the small claims ruled that he was not going to give Beven and Brock a dime for them planting a golf green and trying to RIP ME OFF for it. I won nothing but they lost $1544.00, the judge did give them $147.50 for painting. I was happy.
I also sued them in september for $5000.00, The judge would of given me all $5000.00 except that for the codes the statue of limitations ran out for me, but that was okay because the judge tore them a new ass and moped the court room floor about how they do business.
I was told that day by David Brock the owner, to not worry about paying them the $147.00 and that my credit would be left alone, for us to move on with our lives. Stupid me i took his word for it.in october we were looking to move form where we live now due to the fact that the house i live in now is being sold. We had found out, unaware of that Beven and Brock had put the full amount of $1692.00 and the company we had tried to rent from denied us and seen it as an eviction.
Since then i have paid them the after several attempts to get them to sign the satisfaction of judgement, when i went to pay i spoke to David Brock and asked him why was this on our credit, let alone not updated, he said thing like this happen, i told him to please remove it from our credit report, david brock looked at me laughed and saud that there was not much he could do and told me good luck buddy. The reason that i had taken viedo of the property was beause that house was the third one some one in my family had rented.
They will charge for paint and never paint. Now we are six weeks later up to this day, and Beven and Brock refuse to update my credit report. Even though o didnt owe $1692.00 and its paid in full for $147.50. I am having to write numorous letters to try to get it removed. This story will be updated soon its not over yet. But if its your last resort to have to rent from Beven and Brock or having to sleep on the street with your family, Make sure you make the right choice and take the streets.
