Affiliate program was sold by ASSURANCE PLUS on three (3) on-line companies with advertising being provided through a companion program, DIVERSE MARKETING CONCEPTS, as a separate contract. Repeated calls during the first six weeks of the program, as to NO ACTIVITY, resulted in only idle conversation (and "Things will get better"). With not even minimum results, I stopped payment on my MasterCard for the advertising portion of the program.
We had signed a cancellation form supplied by ASSURANCE PLUS, and when we had no response to follow up letters, I called on february 28 (The original contract was effective on December 5.). At that time I was told that I had accused them of "fraud" by my "stop order", and they could do nothing further because "the matter had been placed in the hands of their attorneys t oprove that there was no fraud". I again stated that my stop order was based on "non-performance", in that we had contracted (by dollar amount) for "15,000 Guaranteed Targeted Visitors" in tbe twelve month advertising contract. As of february 17, we still had not had even one visitor to any of the three (3) affiliate programs. During my telephone conversation with ASSURANCE PLUS on February 28, we discovered that there had finally been five (5) visits on the one program; still nothing on the other two.
Since it appeared that there was no possible way of obtaining any way near the contracted 15,000 visitors (and no apparent concern over attempting to obtain that guaranteed level) with none for at least the first two and one-half (2-1/2) months, and a total of five now in a full three (3) months on the program, it is more than apparent that there will not be "guaranteed" performance.
ASSURANCE PLUS has stted that they would returm my "set-up" fee at the end of six months if I had not made the income, but they also stated that there is no way that they will return any part of my advertising contract AND they intend to prove to my credit card company that they have earned it and "make me pay!"
