I ordered an item (BRAND NEW) from Compu-America (C.A.) by sending a wire-transfer ($401.31) on Feb. 25th, 05 (international order, S. Korea). Barely received the item about 20 days later after much urging, bickering, & stress due to awful customer service.

Their web page for the particular item is misleading because it did not state whether the item is new or refurbished and it still has not been changed (there was no reason to believe they would sell a used item). But just to be on the safe side, when I ordered the product, I specifically said I wanted it to be brand new over the phone (Mitzi). However, upon receiving the product, I immediately noticed it was USED by looking at the item itself as well as reading the warranty portion of the enclosed manual.

Reported this to C.A. And told them I wanted a full refund because I felt like I was being cheated after waiting a month just to receive the product in the first place. Was given a RMA no: 799550 & was promised a FULL-refund by Rick, the person in charge of returns. Now, C.A. Has only sent me a partial refund ($224.40) and is refusing to send me the rest of the amount for reasons regarding their return policy and shipment charge (FedEx service). This is totally absurd and completely intolerable! I paid $171.91 (including customs taxes)
for nothing but their mistake!

When I returned the item, it was not because of a simple change of mind nor was it due to it being a defective product (it wasnt). The reason is quite simple. I returned it because they had made a mistake! (I would have used the item without any problems if it were brand new.) Therefore, neither their exchange policy regarding defective items nor their return policies are applicable in my case. They are in direct violation of Civil Code Section 1770. (a) (6) as well as the Business and Professions Code Section 17500. Although I tried to settle the matter amicably by only requesting the remaining sum of $166.91, Compu-America showed no willingness to comply. It is obvious that they are trying to take advantage of me based on the fact that I am overseas. Due to their unacceptable behavior and unprofessional attitude, I am now demanding all of the money I have lost in dealing with them:

On a note, Compu-America only sent me $224.40 when they said they were sending me $234.40. So the actual remaining amount is $176.91. I am also demanding Compu-America pay me $60 in international phone expenses and the $41 for customs taxes I had to pay for their mistake. The sum of what they owe me is $277.91 and not a penny less. If they do not compensate me for this amount, I will ensure that this kind of illegal business conduct does not happen to other innocent customers by doing everything in my power to expose these crooks to the American public.
