Ripoff, unauthorized billing, refusal to accept declined product

I saw a commercial for "Dromias, " a non-prescription sleep aid. I researched the product online and signed up for a thirty day free sample. I entered my credit card number for shipping and handling. I did read the small print about automatic billing, but decided to give the product a try before canceling.

I ordered dromias on July 9th and received the shipment on July 15th. On August 1st, my credit card was billed 70 dollars. I read that the next shipment was due about five days prior to when the thirty day sample would run out. Mathematically, the charge is just too darn soon! It's within the thirty day trial and it's too soon for them to claim "shipping five days prior to when your sample would run out."

I phoned what passes for "customer service, " only to be on hold for thirty five minutes. A customer care agent then explained that the billing isn't according to YOUR order, but rather THEIR billing cycle and in order to know what that is, you'd have to work for Berkeley Pharmaceutical. Nowhere on their website does it state that they make shipments on the 8th of every month and you will be billed a week prior. If the truth is that they bill everyone on or about the 1st, their website should plainly state that. They refuse to refund the money (although the shipment has NOT been sent out) and they will only offer me a "refund" if it is in the form of MORE of their products—which I am NOT interested in.

To the woman who issued a rebuttal by claiming she ordered the product and canceled the same day—you may think you are very smart, but that is not the spirit of the trial offer and I think those types of morals are similar to those of Berkeley Pharmaceuticals—neither of which are very high. If the company were reputable, they would admit that their billing practices are misleading, their product is overpriced, and basically the "free" thirty day trial is a scam. I have put a claim in on my credit card that this charge is unauthorized and it will NOT be paid. A word to the wise&avoid this scam& unless you are also ethically challenged and plan on canceling the same day you sign up.
