I tried the trial of the Acai-advanced, fully aware that if if i didn't call within the 15 days required to cancel i would be paying for that first bottle. What i was not aware, because it was not written clearly enough in their terms, that i had to call to cancel my entire order for acai within that 15 days so that i wouldn't be paying for future bottles.
The terms do not state that when you try to cancel your order, you cannot return or refuse the package for a refund. I tried to do this when the bottle arrived, but i was told i still had to pay for the product because i didn't cancel within 15 days. I was aware of the responsibility of the payment for the first bottle, but it was not clear that that i if i cancelled past the 15 days, i was now unable to prevent future charges.
Here are their terms
You will have 15 days from your original purchase date to decide if Acai Advanced is right for you. If you are enjoying Acai Advanced do nothing and at the end of your 15 day trial period you will be charged the low rate of only sixty four dollars and ninety five cents for the bottle you received. Approximately 30 days from your original purchase date and every 30 days thereafter you will be sent another 1 month supply of Acai Advanced and your credit card on file will be billed the Healthy Lifestyle's Member's Only price of sixty four dollars and ninety five cents plus nine dollars and ninety five cents for shipping and handling for a total of seventy four dollars and ninety five cents. That's 30% off the regular price for a 1 month supply of Acai Advanced. You may cancel your membership at any time by simply contacting customer service. Please remember, most customers see most noticeable results by using Acai Advanced consistently for 3 months. You may contact our customer service department via postal mail, email, or by using our toll free phone number. Customer service hours are between the hours of 9 am till 5 pm PST, Monday through Friday.
It says " you may cancel your membership at any time by simply contacting customer service." It does not say that if you did not cancel within 15 days are you liable for the 2nd bottle that gets sent out.
This is purposefully vague and incomplete information. It's bad enough that you have to read the fine print about the Living Lean charge they through in there, but if you return the product you should be able to get a refund, because it does not state anywhere that you cannot do that.
Here is their next section, equally vague:
Negative Option Clause:
I understand that this consumer transaction involves a negative option, and that i may be liable for payment of future goods and services under the terms of this agreement for sixty four dollars and ninety five cents plus nine dollars and ninety five cents for shipping and handling per month if i fail to notify the supplier not to supply the goods or services described.
It does NOT state that this future liability applies if you did not cancel within the first 15 days. That is not stated. It is loosely related in this vague statement. I did NOT "fail to notify the supplier not to supply the goods or services described." I did call them and wanted to return that product. It does not clarify returns or exact timing of this notification for the supplier.in fact in the package it even says call customer service if you want to return product. Which i was told is NOT an option.
Their information is not clear enough for the consumer to actually know the details of their cancellation. It is purposefully written vaguely to take advantage of people. Even those who read all the terms and conditions as I do.
