Home Instead takes advantage of women and the working poor

Home Instead Senior Care takes advantage of the poor. Caregivers work up to twelve hours a day without overtime. The caregivers are require to sign a contract stating that he hours are not guaranteed. The application online has full time and part-time positions.

When the employee attends orientation they are told to sign a contract stating the they are part-time workers and that some client may go into hospital or other health care institutions. Home Instead starts some of their employee on 12 hours shifts if they are able to do it. The applicants are told that they would do as need jobs and soon after that they would be assigned permanent clients.

They are constantly hiring new employees even though they don't have enough hours for the employee already working for them. When employees hours are reduced after working overtime hours for months they become extremely angry when the employees apply for unemployment. Home Instead says that employees are not entitled to unemployment because employees signed a contract stating that their hours aren't guaranteed. There were many things on that contract that Home Instead didn't honor, (example) training and continuous training were never given to employees.

When Home Instead finds out an employee has applied for unemployment they give the employees a living hell similar to a trail by fire. They start calling to the employees throughout the day and morning trying to build up a case against the employee. They will tell the unemployment agency that they tried to contact the employees but the employee wasn't there and didn't return calls even though the employee did. The employees are not paid to be on call. If they can't reach the employees within 15 minutes they are supposed to move on the the next employee. That doesn't work if the employee files for unemployment, they will call you and hunt you down in order to bill up a faulty claim to present to the labor department. Home Instead also stated that they didn't have full time hours available but still most of their employee worked overs times hours.

Home Instead is getting thousands and thousand of dollars monthly from clients Insurance and medicare for the services performed by their employees. Home Instead only pays their employee $6.55 per hour for day shifts and a very small nightly rate of $55.00 (rip-off) a night. The hours for the day and night shifts are the same but less pay. We are not paid over time even though 20% of our work involves household work.

I think this company needs to be audited and a class action law suit should be filled against them for overtime violations. There is something very crooked going on at the particular Home Instead franchise. I need to know who can I write to address this issue and to get help.

Caregivers work just as hard or harder as any other worker. It takes between four of six days after the time goes in before employee can pick their checks. This is awful, the employee is already struggling to get to work and pay bills. That makes the worker among the poorest working people in the city. The laws should be changed to revoke their exemption status for overtime and minimal wages ASAP.
