On 11/19/06 I orderered a free sample of Phentrazine 37.5.
Before placing the order, I reviewed the T&C, which stated that I would be only charged S&H and one week later I would be enrolled in their automatic shipment program, which I could cancel prior to my credit card being processed.
No cancellation penalties were mentioned.
On 11/ 24 I received the trial. I then decided to cancel future shipments. I called to cancel my account but was told to call back on Monday because they were closed for Thanksgiving. When I called back I was told that they could only help me via a support ticket. So I opened a support ticket (the link I had was dead but I eventually found the correct one) asking for my account to be cancelled.
"Bryan" responded that there was a $49.95 cancellation fee. I replied saying that this wasn't stated anywhere in the T&C and why wasn't I advised of that. He said that by cancelling I would break my agreement so they would charge 39.95 for the initial bottle and $10 cancellation fee.
I replied that their T&C didn't state this anywhere and why didn't they disclose it initially.
He told me to call back asking for extension 100 and talk to "Brandy".
On 11/29 I called, got her voicemail and left a message. She hasn't called back yet.
I found many bad reports on them here and I am getting really discouraged about being able to cancel my account without incurring any fees. I don't think I should pay any penalty because, first of all they called it a FREE trial, and secondly because their T&C wording was completely deceiving. I believe that any fees/penalties should be clearly disclosed in the T&C.
I am willing to dispute any future charge with my bank, however I am afraid of possible legal consequences/negative information on my credit report.
