Iphone 4S lost phone AT&t not resposible shipping states it is delivered

Hi,
I am really frustrated with AT&T any solution that could help me fix this issue is greatly appreciated. I have a family plan with At&t for over 2 years, everyone in this family plan are using Iphone 4S. On late September we received a letter from AT&T stating that we can add another person to our family plan. Excited by this news on October 7th i ordered an Iphone 4s for a family member.

The person named Royal AT&T representative told me the news is correct and he went ahead and added to the family. Later on November 28 we found out that the line was added as individual and not into the family plan. I called AT&T to cancel the phone and explained what happened, the manager said, since it is their mistake he will cancel the phone and refund all the money even though it passed the 30 day return time.

He told me, he will do it in one condition if we could send him the iphone 4s back. Since it was our upgrade time everyone ordered an Iphone 4s White for themselves. We the phones arrived it was, for some reason the phones were swiped between the family members. We i received the shipping label in my email, i affixed to the top of original packaging that the phone came with and sent it back. The phone was sent on December 15 to the AT&T facility in Texas according to the tracking number it was delivered on December 30th. On January 11th i called to see if the phone has arrived and the when they are going to send the refund.

I was informed that the phone is still being used and they have never received a phone from me. I was really frustrated and keep talking back and forth with AT&T, newgistic (their shipping partner) and USPS as to where the package went. Every day after January 11th i have been talking with one of their representative explaining all of the above for forty minutes to one hour. They are keeping telling me they haven't received the phone.

The went ahead and cancel the phone but with an early termination of $305 and charged $90 for the month of January and December. Today i called and talked for another 50 minutes and the rep told me that "you send the wrong phone and you are responsible for it" and "when we get a phone we ship back to manufacture" How come they ship it back Apple without a record in their system.

Apparently i have to $305 for the early termination fee and i have lost a phone that is worth $645 (retail price with no contract) I have a copy of the smart label, shipping history but they are still saying they haven't received a phone yet. Any solutions? It has given a depression and everything i think about it i can't focus at my job. I feel that my rights are taken away and they are not listening to me. I have become very hopeless and this is the only to get the word out there.
