American Cellular Wanted to Charge A restocking fee on a defective phone!

I recently purchased a new Eris 6200 Droid to upgrade my service. I bought 2 of these. The first problem I was having was I had to charge the battery 3 times a day. I went back and they gave me a different battery, that still didn't solve that problem, I ordered a larger capsity battery, well now I am only charging it 2 times a day. Well I placed all my phone numbers and email address info into the new phone. I get a text that I have an update ready to be installed. I followed the instructions, when it was finished, all my phone numbers (all 3000 of them) were gone. I called customer service, they said well this may have been a fluke. I said I do not trust this phone if everytime it gets an update I lose everything. Well the other Droid went on sale a day later the Motorola Droid Buy 1 Get one Free. So I asked about swapping out my droid for a Motorola Droid. I have sent in the rebates for the phones I already have but was only going to take 1 not 2 of them so the phone price was still in their favor.
