Ripoff Fraud: Listed Brand New Olympus Digital Camera, Shipped 2003 Refurbished, Reconditioned Product, Unresponsive on Return, PayPal Complaint, Said would refuse return

May 10th—Won a supposedly new Olympus Digital Camera:
http://cgi. Ebay.com/ws/eBayISAPI. Dll? ViewItem&item=7616758978.
Paid $213.25 immediately through PayPal. This listing for the Olympus Digital C-60 states "Brand New!" in the title; and Condition: "New, Never Opened" with "BRAND NEW IN BOX
14 Day Return Policy - Satisfaction Guaranteed!" in the description in rather large print.

May 13th—My Question of Mitch: "Hi there. Thanks for this tracking number. I see that it states Los Angeles, CA. Is this being shipped as a dropshipper item as I see you're located in Dallas, TX? Just curious. And it is new, right? Not refurbished."

May 13th—His reply: "Yes its new and from a distributor."

May 18th—I received the package through FedEx showing that the dropshipper was:

May 18th—My Message through eBay to mitchelljayreiff: "Mitch, as you know, I previously asked:...'Hi there. Thanks for this tracking number. I see that it states Los Angeles, CA. Is this being shipped as a dropshipper item as I see you're located in Dallas, TX? Just curious. And it is new, right? Not refurbished.' You responded 'Yes its new and from a distributor.' HOWEVER, the item arrived today, in a partially dented shipping box with the camera box stating Reconditioned Refurbished Product 11/23/05—That is clearly NOT a NEW product or Brand New! As your listing clearly states. I will be consulting with my husband when he gets home this evening to get his input. No where in your ad did you state refurbished or reconditioned."

May 18th—Direct email to Mitch Reiff: "Mitch, As I mentioned in my previous email, through the listing on eBay, the Olympus camera is not Brand New! As you stated in your listing. It is a Refurbished Product and also marked Reconditioned. I specifically asked if it was "not refurbished" and you assured me it was brand new. The pictures I've attached are of the camera box.

Also, the shipping box was dented, as you can see in picture 3. I could hear the camera "rattling" around in the camera box—with all the other parts—in other words, it could have been packaged within the camera box to protect the camera better.

When my husband gets home this evening, I will be consulting with him to see how he would like to proceed with this matter.

Personally, I'm not very happy that you did not tell me the truth and that your listing is inaccurate."

May 18th—My Message through eBay to mitchelljayreiff: "Mitch, My husband says that I should return this immediately, plus send you a bill for $100 for the waste of my time. I want ALL my money back—including shipping—because you misrepresented the product. Plus, it would seem fair that you arranged to having fedex or ups pick up the product from me. I see you are a relatively new seller. This is NO way to build a reputable business by misleading your buyers. I expect to hear from you in a timely fashion with rectifying this issue."

Mitch Reiff did not reply to my emails.

May 18th—Advised eBay through Safe Harbor that item was significantly NOT as described. "Customer concern: I have emailed the seller to advise that I received a product
that was NOT Brand New! But marked as Refurbished 11/23/05 and Reconditioned. He clearly confirmed that the product was brand new in an email to me before I received the product. I've sent him a picture of the camera box to show that it is NOT new."

May 19th—Opened PayPal Complaint—My Comments: "I did a lot of researching on eBay to determine which NEW digital camera I wanted to buy. I bought on eBay what I was told was a BRAND NEW, NEVER OPENED, NOT REFURBISHED Digital Camera. The listing stated: Item name: Olympus 6.1 Digital Camera with 12x Zoom - Brand New! Item number: 7616758978. Condition: New, Never Opened. Http://cgi. Ebay.com/ws/eBayISAPI. Dll? ViewItem&item=7616758978 This product was misrepresented and I was even told, in an email by Mitch Reiff, that I would be receiving a New, not refurbished camera. I've sent several emails to the seller, who has yet to respond. I sent him also an email of 3 pictures showing the semi-crushed/dented outer shipping carton, plus pictures of the camera box with "Refurbished Product 11/23/05" and "Reconditioned." And, a note that the camera was loosely put in bubble-wrapping at the bottom of the camera box and was rattling around next to the battery charger.in other words, not expertly packaged for a camera. I've requested that the seller arrange to have this picked up as I want to return for a full refund for a misrepresented product."

May 20th—PayPal—My comments: "Dear Mitchell Reiff, I am NOT look for shipment tracking information. You TOLD me in an email explicitly that I was getting a brand NEW Olympus digital camera.inSTEAD, I RECEIVED a "Refurbished Product 11/23/05" and "Reconditioned." I do NOT want this product because I did not receive what I paid for. I don't want a refurbished / reconditioned camera. I want to return it immediately for full refund of my $213.25. If you can arrange for FedEx to PICKUP this refurbished camera, that would be commendable on your part. Plus, I'm awaiting a full refund."

May 20th—PayPal—My comments: "... I'm asking for returning instructions—where to ship this, if it is your DROPSHIPPER: Click2U.com 1600 Naomi Avenue Los Angeles, CA 90021 Or if it is someplace else. And I expect a FULL REFUND!"
