This is truly sad because it is the second incident i have had with the allegheny county family court system. I have been fighting for custody of my son since i left my ex wife in 2000 my son was two. I didn't have an initial hearing for custody until 2004. The judge at that time was Eugene Scanlon. Rumor has it that he did some unethical things and is no longer judge in Allegheny county family court system. As you may or may not be aware with the system one must go through generations and pay an absurd amount to be psychologically evaluated. I only bring this up because i have never seen the results of my x-wife taking any such exam that is some 586 questions long, (she claims she can't read) the evaluator at that time (Bruce Chambers) is also no longer with the allegheny county court system because rumor has it he too did something very unethical.
Now to get to my point my son is now 15 years old. His mother has had primary physical custody of him since the hearing in 2004. Now my son has a learning disability nothing major just ADD and in grade school had aids to help him in school. Then when he went to fifth grade (middle school) i had him tested at Sylvan learning center. He tested at a 3rd grade reading and math level in 2008.By the end of his 7th grade year when his mother and i both signed off on his I.E.P. (individualized educational program) that neither one of us was satisfied. I decided to take her back to court for custody for educational issues. Now i started this in march. Well since it had been over 7 years, we were forced to go through the entire process again. Needless to say his mother and i don't see eye to eye and we will never agree on even the simplest of issues regarding our son. You see my son was tested again by sylvan in 2011 and he had not improved intellectually since he was tested last in 2008. He was in 7th grade with a reading and math level of a 3rd or 4th grader. Now i asked his mother to give me custody of him so that i could help him with school and get him caught up (sylvan assured me that he could be caught up within a year). I explained that i was a college graduate and that i would pay for any extra help he needed until he was brought back to his grade level at sylvan. Sylvan is very expensive and i agreed to pay for all of it not only to my x-wife but to the honorable Judge Arnold Klein. Rather than either one of them taking me up on my offer the judge decided to drag out my case for 18 months, waste another year of my sons life and then rule that he stay with his mother for social reasons and her extended family. Now currently i have this in appeals court and am hoping for a reversal to help my son.
The reason i am writing this is in hopes that people from the news media will take an interest in this so that i can explain in more detail and provide some proof of favoritism in the allegheny county court system. I have been through this system for the past twelve years and in both hearings in 2004 and in 2012 i won in court. Yet somehow i was not granted custody. The reasons i was not granted custody were both very similiar and absurd. The first was that because she had custody most if not all of his life that the court was going to honor that, and also because she remarried and was moving into a new home that she brought pictures in to show judge scanlon. She thus moved out of the area one hour away from me. The last ruling by judge arnold klein was because again she had custody most if not all of his life and because she had a larger extended family than i did. However, this extended family is not hers but her new husbands relatives. I care not to go into this any further until i am contacted by a media person to bring out the truth of what the allegheny county family court system is doing to our children.
