Unauthorized e-check deducted from my bank account for $39.90 ripoff

I signed up with an account with GreenZap sometime in 2006 thinking they were like you know Paypal and hey who doesn't want $25 free cash for signing up? Well, I got more than I bargained for when I did.

A few months went by and they charged me through my debit card. I told the bank that I never agreed to the charge and they still made me pay half the charge plus half the overdraft fee (since I don't keep money in my account unless I know I'm going to buy something or I have a bill coming up.) After that happened I closed and canceled my account with GreenZap (which was September) after figuring out that they were a scam company. I never actually used the account except for signing up. I just want to make that clear.

I never bought anything through there or went gold or anything of the sort. I logged in a few times and just let the account sit there from the time I signed up to the time I got charged.

Since closing the account, about 11 months later I log into my bank account on August 24 and I see that my account is $71.77. Didn't help that again I didn't have any money in the account because at that time I didn't have any bills (which are all coming up in the beginning of September).

I click on my account summary and I see this e-check in my account for some guy or company called Mazumah for the amount of $39.90. I immediately called the bank and reported to them that I didn't authorize this e-check. The lady tried to switch me over to claims and they hung up on me! Since I couldn't get to the bank on Friday, I had to wait all weekend and then go on Monday. During the weekend I did numerous searches and found many reports on this site as well as the word Mazumah linked up with former GreenZap users.

I finally get to the bank, sit down, and talk to one of their representatives. I tell her what happened and how I CANCELED my GreenZap account in 2006. I even tried to show her an email printout of my cancellation with GreenZap and a few reports I found on this site.

She didn't care and didn't even want to look at them. Apparently, she didn't care what I had to say and neither did the woman she talked to at claims (on the phone). Both of them said that since I willingly opened an account (THAT IS NOW DECEASED) with GreenZap there is nothing they can do about it and they cannot refund my money.

But and get this, she says and I quote "I'm not allowed to do this but I'll give you you're money back for the overdraft fee." Excuse me, but that's like telling someone it's okay to have sex with them and then the next time when you say no and mean it - they rape you anyway.

Where does Bank of America and their representatives get off telling me that it's not fraud because I willingly opened an account with GreenZap. An account I had closed and canceled almost a year ago! I refuse to pay what I owe GreenZap or rather now the bank because I'm the victim in this. I would say that canceling out an account signifies that "No, you are not allowed to use my information anymore because I am no longer a user of your service."

Can someone please tell me how I can convince BOA that I am the victim in this case. No matter how many times I tried to tell them that I no longer have an account with this scam company and that I can't even login to my account (which by the way since I canceled that account it comes up and says 'this user is in violation of our terms of service.' I guess that is because I canceled my account.)

I'm guessing that GreenZap really stands for 'We're going to Zap the Green out of your account whether you give us permission to or not.' I was raped by this company, not sexually, but in fact through private information that they should no longer have on record. I can't even use my bank account or even get a new one until I pay (and they expect me to) the remaining money that GreenZap wrongfully took.
