I went to Alans Mini Mart Exxon to fill up my truck with gas. As I was pumping the gas I caught a smell of diesel fuel. I had already pumped $30.00 worth before I caught it. I looked back at the pump to read the label and it read regular unleaded gas. I went inside and ask the owner to please come outside and look at my truck. I'm a female and I wanted someone else to look at it just in case I was right and it damaged my truck. The owner wouldnt come out he walked away from me. He was an Arab man. I then tried to get a gas reciept and they said they couldnt give me one. I had to insist that they give me one so when the owner left the clerk finally did give me a piece of paper that read $30.00 but it had no store name or gallons on it.
So I left the store and got a male friend to go back with me to get his opinion. We purchased more gas in a can. He also said it smells like diesel. I then went to a mechanic and he thought it was diesel also. So I called enviromental Health to come test the gas. They told me to go back to the store and meet them there. I parked at the store out of the customers way waiting. The owner came out and for no reason began screaming and cussing me like I've never been cussed at before. Calling me names and just going crazy on me.
He then took the gas nozzle and sprayed me with gas. I jumped back and he only hit my shoes and the bottom of my pants. He acted like a crazy man.
I left the store and my truck started cutting out so I took it on to the ford company. My truck cost me a little over $38000,00. Its a Harley Davidson Truck. They put the truck in the shop and done a gas analysis test which proved there was gas and diesel mixed in the tank. The damages are $800 to $1000.00 if the motor wasnt damaged. Thats the price for cleanning up the motor only. If it damaged the motor the cost is $5000 to 6000.00.
I now have to pull this out of my pocket to pay for something I didnt have any control of. My husbands totally disabled with M.S. He's wheelchair bound. I dont understand how people can do this and get away with it. The store owner is still selling this gas to his customers. Then I went to get a warrant on him and I was told it was a civil matter and I could'nt get one. This incident happened before lunch that day and I didnt get home until after midnite that nite. It took me that long to find someone to help me.
There shouldnt be any question about where I should get a warrant or not. It was an assult and I shouldnt have had to go through that to get a warrant. This is the first warrant I've ever taken out on anyone and I hope the last I ever have to take out. If anyone has any suggestions please let me know.
