Toledo firm sued for not providing goods

A Toledo business and three other companies have been accused of violating Ohio's consumer protection laws for selling golf equipment in television ads and Internet sites but failing to provide the items to customers.

Ohio Attorney General Jim Petro filed a lawsuit last week in Lucas County Common Pleas Court against Stephen R. Horst and Jason Birch, accusing them of failure to deliver promised goods and unconscionable consumer sales practices.

The suit says they own Golf Technologies LLC, Universal Marketing Group LLC, and Universal Fulfillment, all located at 115 South Reynolds Rd.

They are accused of accepting payments for X-Factor Sports golf equipment, and failing to make timely refund payments to customers when they could not deliver products.

Also named as defendants are Litle & Company LLC, of Lowell, Mass., hired to process payments; King Media and its subsidiary, All Club Sports, of King of Prussia, Pa., which were to ship the products.

None of the parties could be reached for comment. The state is seeking $50,000 in civil fines, compensation for customers, and an order barring the firms from more transactions.
