Charging For Materials We Didn't Received & More! Ripoff

Jan. 2004 we hired a contractor to build our home who insisting on using Home Depot for our building materials. An account was opened and my husband signed on the account. The original agreement made between us and Home Depot was 10% off everything bought for construction and no charges for delivery. Not only has Home Depot consistently charged full price plus $49 for every trip they made (many of those trips were because they delivered the wrong, damaged or defective materials) - their representative took items back for us after a "PR" visit to the building site and has never returned those items.

We were shorted about $10K in material on deliveries that we are being charged for plus they cost more time than we care to count in mistake after mistake. Although the local guys here acknowledge the problems they seem to be unable to fix the bill.

We have paperwork, signed by reps and their driver showing all of the returns, etc. Etc. Simple, right? Well, we sent a long letter in March to the Home Depot credit service and corp. Office and guess what that got us... Turned over to a collection agency.

They are invoicing us out $16,500 right now and at this point we're pretty convinced we've probably overpaid. We sent a dispute letter immediately to their collection agency along with a copy of the letter we sent them. Their response? They call every morning and demand payment (despite the dipute letter) and want to "settle". We haven't checked our credit yet but were assured by the "local guys that b/c of the circumstances they will not report anything"...

I have a feeling the "local guys" don't know anything but if there is anything derogatory on our credit we are suing... Anyone care to join a class action? All we want to do is go over our invoices, show them our paperwork (they gave us) and get to a bottom line dollar amt. If they owe us money they can write us a check and if we owe them we'll pay immediately. They won't even talk to us and when I called this week they told me our account had been "charged off". I'm not sure what that means but they talk to us and referred us to their collection company. Any suggestions?
