Deny ignore stall selective warranty follow through

I closed on an Ashton Woods Home on 6/24/04. The final walk through was pushed back by a/w until the morning of closing day. The landscaping was in very bad shape and was noted on the walkthrough paper work as "tree questionable" and "sod questionable".

The sod made it but all three trees died. I was told the tree in the back yard should have been planted in the front anyway. They replaced this tree and planted it in the front. The dead tree was thrown over my back fence.

The new tree died shortly thereafter. I had a landscaper look at the trees. The holes were too small and they were planted in clay. Water was standing beneath the trees. A/W claims there is no warranty on landscaping.

The A/C has never worked properly. Our elec bills have been $264, $278, and $202. We have a one story 2730 ft home w / one 4 ton air conditioner. A/W guarantees the enegy usage over a 12 month period, so I can file a claim then, but that doesn't fix the problem. This is w/a 76-77 degree thermostat setting.

A/W also guarantees no more than a 3 degree temp difference between the center of any room and the thermostat. A/W is a member of Environments for Living (EFL). The a/c contractor has been out 4 times. I have some rooms that are 70-72 and others that are 76-77.

After reporting on A/W web site, I realized I had no proof of reporting and no record of what I reported. I began to send e-mails. The first e-mail elicited a response from Tonnie Miligan of A/W. She asked if the instruments I was using were purchased at Radio Shack.

I had not informed Ms Miligan that I worked as a distributor rep for a major OEM equipment manufacturer. I have sent many more e-mails since the first direct email on 8/4/04. I have never received a response of any kind. The man in charge of warranty work always says " did you send it in", " I haven't received it yet".

After I contacted EFL they sent a copy of the guarantee of energy useage to me. I should have been given this at closing. EFL also sent out a company on 10/5/04 to check the duct system. I have heard nothing about what was found.

I found the identical home a few streets over and spoke w / the owner. They have never received an electric bill over $150 and keep their thermostat at 75 degrees.

I have other issues, but these are the biggest/most annoying. I initially got nothing but "deny, deny, deny" from A/W. Now I get ignored. No response from the builder.
