I hired Trevor DeSouza, aka Tri State Contracting, on December 27th to remodel my kitchen. He told me that the work would be completed within 6-8 weeks. He cashed my check, which he had me make out to him, not the company, on December 29th. When the 6 weeks came and went, I began calling him to get a status. He did not begin returning calls until the middle of March.
He insisted that the materials were ordered, and he even told me where he ordered them. I called that company, and they never heard of him, had no record of an order, nor did they have any money from him.
I called Trevor back, and he told me that he applied for a new dealer application with this company, which is why it was taking so long. I called the company back, and they said that he might have done that, but it would have required a credit check. I found out through the bankruptcy court in Trenton, that he (the individual, not the company) filed for bankruptcy on December 15th, 2 weeks before cashing my check.
I wrote him a letter and demanded that my money be refunded by Friday, March 26th, in the form of a certified check, or I would continue to pursue legal action and contact the police. I called him on Saturday, and he told me that his bank said the funds were not available.
He then told me "Do what you have to do. If you have to go to the police, then go to the police."
