Signed contract with Mighty Joe Young Construction Co. On Sept, 7th and gave him an initial check for $5040.00 as a down pmt. Work to be donewas knock down existing 2nd story wood deck, and replace with a deck made of composite decking material, vinyl siding on house, new bathroom floor, fix bannister going upstrs, insrtaal roof on shed and remove all rubbish.
His crew demolished the deck the second week of Sept. He came back on Oct. 4th and we gave him the second check as stated on contract for $3,780.00. He said the deck would be done by Oct. 31 or he would deduct $1.000. I told him I wanted him to put that in writing on the contract as well as put in dates of completion for all the other work. He took the contract and said he would bring it back the next day, since he was in a hurry to go give someone an estimate. He never returned it.
I called him repeatedly and left messages for him to call me back. He never did. I managed to surprise him using my friends phone so he wouldn't recognize my # on Oct. 18th and he said his crew would be there on Friday the 19th and have the deck done by Monday the 22nd. Again no show and no returning of messages.
Surprised him again on the 25th of Oct. And he had a sob story about most of his crew quitting. I said that was no excuse for not treturning my calls. He kept apologizing and said that the job would get done. I said if he couldn't do the job to just refund my money. He said not to worry he was not going to rip me off. Still a no show and not returning calls.
My husband surprised him on Nov. 14th with a phone call demanding our contract and that he either return our money or complete the job. He said he would call us over the weekend. No show and no return of phone messages.
I consulted a lawyer who wanted $3500 for a fee and couldn't guarantee the return of our money. I certainly can't afford to lose another $3,500.00 after losing $8,000. Also, now I'm going to have to hire someone to remove whats left of my old deck that sitting in a heap in my back yard. My yard looks like Afganistan. Thats my sad story.
I hope someone can help me. I haven't slept a whole night since this nightmare began. I'm literally sick over the whole mess.
