Furnace Warranty Avoidance

I purchased a new home in August of 06. A Fedders furnace was purchased and installed by a licensed heating and air conditioning company sub contracting under the supervision of reputable general contractor that build the home. The furnace is a "Texas Furnace" that was apparently bought/sold under the Fedders name. A couple weeks ago the mother board in the unit went bad. After checking warranty information I realized it should still be under warranty. After calling and finding out that Fedders was purchased by Airwell and is now Airwell-Fedders I called customer service and gave all the required information to the customer service rep regarding my unit. She proceeded to tell me that I no longer have a warranty even though I have warranty docs in my hand. She did pull up my Model # and find my unit by Serial #. Apparently Airwell bought Fedders which was in bankruptcy, but the did not buy their liability. Basically Airwell was able to buy the "Name" but didn't have to take on any of the responsibility of Fedders. After a little persistance I was given a web address so that I could file a claim with Fedders under the bankruptcy. I'm looking into that now but It really seems like a run around.

I called Texas Furnance Directly and the service guy "Very Nice" told me that it is under warranty and that the HVAC service company that I am using to do the work can fill out and RGA warranty tag when they purchase the mother board. I am forwarding this info back to my contractor and hope for the best. They had previously told me that Texas Furnace was not going to cover it and that we had to deal with Airwell-Fedders directly.
