This is a complaint against Lowes Home Improvement @ West Chandler, Arizona for intentionally damaged both my husbands and my credit reports with credit agencies and failure to refund the balance due as I have requested on my Lowes account.

With Lowes special promotion for both 10% discount on purchase and a 6-months defer credit plan, I ordered kitchen cabinet material to be installed on May 28. It is to my regret that it took eleven months to complete the installation of my cabinets eight months behind schedule. The cabinet design by Lowes was faulty and there were numerous cabinets returned and exchanged. The resulting confusion on the installation of our cabinets forced me to reconcile the charges on my Lowes account. Below is a list of facts that I have encountered with Lowes:

A) Under the Fair Credit Billing Act, my letter claiming a billing error must be acknowledged by the Lowes in writing within 30 days after it is received, unless the problem is resolved within that period.in any case, within two billing cycles (but not more than 90 days), Lowes must conduct a reasonable investigation and either correct the mistake or explain why the bill is believed to be correct. Fact: Lowes fails to resolve or explain my dispute for the cabinet charges within two billing cycles.in fact, As of 06/30, Lowes has not provided me with any explanation or clarification for charges of cabinets on my Lowes credit card, including those items that were returned and picked up by Lowe's.
(B) Under the Fair Credit Billing Act, I have disputed about billing errors on my Lowes credit card for the followings:
Failure to credit the returned merchandises for items pick up by Mr. Tom Rose @ Lowes on 02/04/01.
Failure to provide the explanation or clarification for charges of the cabinet installed as I have requested.
Failure to provide the proof of bad debt discharges of 2,953 as I have requested
Charged for cabinets we didnt accept and not installed.

(C) Under the Fair Credit Billing Act, I could have withheld payment on the disputed amount during the investigation and pay part of the bill not in question.
The dispute amounts were $20,174.37 and $2,127.89 (a total of $22,302.26) and the non-dispute amounts were $2,433.50, $248.50, $5,461.20 & $3,834.32 (a total of $11,977.52.)

Under the Fair Credit Billing Act, I was required to make the non-disputed amount of 11,977.52 by the expiration of promotional date 06/02/01. However, please note that I made a payment of $29,951.72 to my Lowes credit card account on 05/31/01 via Overnight Deliver. The status of my Lowes account was current as of 06/02/01. But Lowes intentionally damaged both my husband and my credits by reporting derogatory information to Credit Agencies.
(D) Under the Fair Credit Billing Act, while the dispute settlement procedure is going on, Lowes may not take any legal or other action to collect the amount in dispute. During the dispute period, Lowes has engaged two collection agencies to collect the disputed amount: Jerold Kaplan Law Office, PC and Wolpoff & Abramson, LLP
(E) Under the Fair Credit Billing Act, Lowes may not threaten my credit rating or report me as delinquent while my bill is disputed.

Fact: Lowes had improperly reported both my and my husbands accounts as delinquent and bad debt charge-off to the credit bureaus The only derogatory report for the charge-off on my credit report was from Lowes and, as a result, I have been refused credit for my credit application. I have spent enormous time and efforts to provide Lowes with detail explanations for the charges on my Lowes credit card account. After two years on 06/09, Lowes finally admitted its mistake by agreeing to delete all derogatory information from our credit bureau file.
(F) The finally issue: Under the Fair Credit Billing Act, Lowes must promptly credit or refund overpayments and other amounts owed to my account. I have requested refund on my account as early as 01/03/02. I have yet to receive the refund from my Lowes credit card account.
