California civil code 923 mold remediation fraudulent inducement to remain in house

1.in early 2007 John Laing Homes (JLH) along with Quick Serve Carpet Care began a mold remediation project at our home due to a defective toilet wax ring.
2. Before the repair I requested that JLH conduct a test on the main piece of contaminated drywall to determine the type of mold found. I stated that I wanted that for two reasons:
A. When we sold the house it would be valuable to show prospective buyers.
B. I didn't want to stay in the house if the mold was "toxic".
3. The JLH employee agreed.
4. Shortly after removing the drywall I asked the JLH employee specifically about the test and he said the piece had been tested and it passed. I asked for the results and he stated he would give it to us after they were done since he had other things to give us at that time anyway.
5. Based on this, I agreed to stay in the house. I work from home and the area being worked on was between my office and my son's bedroom.
6. Following the removal of the drywall, Quick Serve Carpet Care sprayed some chemicals and set up fans to circulate air in the work area. The next day I had some type of reaction (I took a picture). My nose turned bright red and my eye developed a scab.
7. After approximately five weeks the job was completed. At about the same time I started to get sick.
8. At that time, I requested the test results from the bulk sample from our JLH contact who was leading the job.
9. After much stalling the employee's supervisor arrived at our house and stated they never tested the drywall sample.
10. About three weeks later I became very sick with what doctors said was bronchitis. I remained sick for 3 months. I was also diagnosed with asthma. I have never had asthma before and I am 44.
11. About six/seven months after the end of the repair our son was diagnosed with leukemia.
12. Since the end of the repair I have been sick about 60% to 80% of the time. Obviously, our son has been sick 100% of the time.

I have asked both Quick Serve and John Laing Homes for a list of chemicals used in our home during the repair and they have refused to provide it. I'm sure everyone would would want to know what was used in their home given these circumstances. Furthermore, we are entitled to this under the civil code section 923.

In Short John Laing Homes has done the following:

1. Committed fraud to induce us to stay in the house during the repair.
2. Knowingly destroyed evidence that I requested, and they agreed, be tested.
3. Refused and continue refusing to comply with civil code section 923.
