Yesterday (October 9th), while walking to the Regal movie theater in Fishkill, NY a UPS driver failed to give my wife, son and myself the right of way while crossing the parking lot within a marked crosswalk. We had to stop abruptly or be struck by this driver as he proceeded past us wearing white earbuds. I called out "thank you" as he drove past. The driver responded by giving me the finger and honking his horn repeatedly. While waiting on line to buy our tickets, the driver came into the theater where he was either picking up a package or dropping off between 1:35 and 1:45 pm. I walked over to him and told him that it wasn't right that he failed to give us the right of way while crossing in the marked crosswalk. His answer was that we were five feet away from the crosswalk and told me that he had the right of way. As he walked away he gave me a thumbs up sign, got into the truck and drove away honking the horn repeatedly as he left. I spent 20 years in law enforcement and I can tell you this, he failed to yield to pedestrians within a marked crosswalk, honked his horn several times (other than danger) and was driving with white earbuds which looked like IPod earbuds which is also against the law. This driver needs to be instructed on the rules of the road and safety regulations which he clearly has no regard. NY license plate # 79732-JV
